Except as otherwise provided in subsection B of this\n\nsection, records obtained by the Administrator or filed under this\n\nact, including a record contained in or filed with a registration\n\nstatement, application, notice filing, or report, are public records\n\nand are available for public examination.\n\nB. The following records are not public records and are not\n\navailable for public examination under subsection A of this section:\n\n1. A record obtained by the Administrator or created by a\n\nrepresentative of the Administrator in connection with an audit or\n\ninspection under subsection K of Section 1-305 or subsection D of\n\nSection 1-410 of this title or an investigation under Section 1-602\n\nof this title;\n\n2. A part of a record filed in connection with a registration\n\nstatement under Sections 1-301 and 1-303 through 1-305 of this title\n\nor a record obtained under subsection K of Section 1-305 or\n\nsubsection D of Section 1-410 of this title that contains trade\n\nsecrets or confidential information if the person filing the\n\nregistration statement or providing the record has asserted a claim\n\nof confidentiality or privilege that is authorized by law;\n\n3. A record that is not required to be provided to the\n\nAdministrator or filed under this act and is provided to the\n\nAdministrator only on the condition that the record will not be\n\nsubject to public examination or disclosure;\n\n4. A record in a litigation file;\n\n5. A nonpublic record received from a person specified in\n\nsubsection A of Section 1-608 of this title;\n\n6. A record obtained by the Administrator through a designee of\n\nthe Administrator that a rule or order under this act determines has\n\nbeen:\n\na. expunged from the Administrator's records by the\n\ndesignee, or\n\nb. determined to be nonpublic or nondisclosable by that\n\ndesignee if the Administrator finds the determination\n\nto be in the public interest and necessary for the\n\nprotection of investors;\n\n7. Any Social Security number, residential address unless used\n\nas a business address, and residential telephone number contained in\n\na record that is filed; and\n\n8. Any records concerning a participant in the Department's\n\ninvestor education program that would be individual student records\n\nor communications subject to the protections of Section 24A.16 of\n\nTitle 51 of the Oklahoma Statutes or the Family Educational Rights\n\nand Privacy Act unless authorized for release by the parent or\n\nguardian of the participant or by the participant if he or she is\n\neighteen (18) years of age or older.\n\nC. If disclosure is for the purpose of a civil or\n\nadministrative investigation, action, or proceeding brought by the\n\nAdministrator or a criminal referral made by the Administrator or to\n\na person specified in subsection A of Section 1-608 of this title,\n\nthe Administrator may disclose a record obtained in connection with\n\nan audit or inspection under subsection K of Section 1-305 of this\n\ntitle or subsection D of Section 1-410 of this title or a record\n\nobtained or created in connection with an investigation under\n\nSection 1-602 of this title so long as the receiving person\n\nspecified in subsection A of Section 1-608 of this title provides\n\nassurances to undertake such safeguards as are necessary and\n\nappropriate to protect the confidentiality of files to which access\n\nis granted and information derived therefrom.","path":["OK Code","Title 71"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os71.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d2abe1cb48f8ba810a30617eda3be538a02b16b8ef0eb528690a7e5d7724e93f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-71-71-1-606","next":"us-ok/okla.-stat.-tit.-71-71-1-608"},"notice":"GroundRules: Original legal text.
