Within ninety (90) days from the date of filing a completed\n\napplication for registration, the Administrator shall issue an order\n\nregistering the subdivided lands or denying the application for\n\nregistration. If an order of denial is not issued within ninety\n\n(90) days, the land shall be deemed registered unless the applicant\n\nhas consented to a delay or the application has been withdrawn. If\n\nany amendment to the application for registration is filed prior to\n\nthe time when the land shall be deemed registered, the application\n\nshall be deemed to have been filed when the amendment was filed.\n\nB. An application for registration may be filed by the\n\nsubdivider or any other person on whose behalf the sales are to be\n\nmade, but the Administrator may require that it be executed by the\n\nsubdivider.\n\nC. Any document filed under this Code within five (5) years\n\npreceding the filing of an application for registration may be\n\nincorporated by reference in the application for registration to the\n\nextent that the document is currently accurate.\n\nD. The Administrator may by rule or otherwise permit the\n\nomission of any item of information or document from any application\n\nfor registration.\n\nE. The Administrator may, as a condition of registration and at\n\nthe expense of the subdivider as specified in subsection A of\n\nSection 652 of this title, investigate any subdivision required to\n\nbe registered under this Code for the purpose of verifying\n\nstatements contained in the application for registration and for the\n\nprotection of prospective purchasers. For the purposes of such\n\ninvestigation, the Administrator may:\n\n1. Require that a report or opinion by an independent\n\naccountant, engineer, appraiser or other expert be prepared and\n\nfiled;\n\n2. Make an examination of the business and records of the\n\napplicant or subdivider;\n\n3. Use and rely on any relevant information or data concerning\n\na subdivision obtained by the Administrator from any federal, state\n\nor local government or agency thereof;\n\n4. Conduct an on-site inspection of each subdivision;\n\n5. Conduct an annual on-site reinspection of each subdivision\n\nfor each of the three (3) years after the expiration date of the\n\nregistration or any renewal thereof;\n\n6. Make on-site examinations or designate a representative to\n\nmake such examinations. Where additional technical, expert or\n\nspecial services are used, the actual cost of such services may be\n\ncharged directly to and shall be paid by the subdivider being\n\nexamined; and\n\n7. Where an on-site inspection of any subdivision has been made\n\nunder this Code, an inspection of adjacent subdivided lands for\n\nwhich a subsequent application for registration is filed may be\n\nwaived and an inspection thereof may be made at the time of the next\n\nsucceeding on-site inspection.\n\nF. The Administrator may require that any subdivided lands be\n\nsold by use of a specified form contract or agreement, and that a\n\nsigned copy or conformed copy of such signed copy be filed with the\n\nAdministrator or preserved by the subdivider for a period of up to\n\nfive (5) years.\n\nG. The Administrator may by rule or otherwise impose other\n\nconditions under which subdivided lands registered under this Code\n\nmay be sold, provided such conditions are reasonable and in the\n\npublic interest. The Administrator may require an escrow, trust or\n\nsimilar arrangement to reasonably assure that all improvements\n\nreferred to in the application for registration will be completed\n\nand that purchasers will receive the interests in land for which\n\nthey have contracted.\n\nH. A registration is effective for one (1) year from its\n\neffective date or for such longer period as the Administrator may\n\npermit by rule or order. No application for registration or\n\neffective registration may be withdrawn at any time after its filing\n\nunless permitted by rule or order of the Administrator. No\nthat purchasers will receive the interests in land for which\n\nthey have contracted.\n\nH. A registration is effective for one (1) year from its\n\neffective date or for such longer period as the Administrator may\n\npermit by rule or order. No application for registration or\n\neffective registration may be withdrawn at any time after its filing\n\nunless permitted by rule or order of the Administrator. No\n\nregistration is effective during the time a stop order is in effect\n\nunder Section 628 of this title.\n\nI. During the effective period of a registration, the\n\nAdministrator may by rule or order require the person who filed the\n\napplication for registration to file reports, not more often than\n\nquarterly, to keep reasonably current the information contained in\n\nthe application for registration and to disclose the progress of the\n\nsales. If any of the lands registered have been sold in this state,\n\nthe Administrator may by rule or order extend the period for filing\n\nthe reports for an additional period not exceeding two (2) years\n\nfrom the date the registration became effective or the date of the\n\nregistration period's latest extension.\n\nJ. The subdivider or registrant shall immediately report to the\n\nAdministrator any material changes in the information contained in\n\nthe application for registration.\n\nK.
