It is unlawful and deemed a Class D3 felony offense for any\n\nperson, in connection with the offer or disposition of subdivided\n\nland, to publish, circulate or use any advertising concerning the\n\nsubdivided land which contains:\n\n1. Any untrue statement, omission or pictorial representation\n\nof a material fact which under the circumstances makes the\n\nstatement, omission or pictorial representation misleading; or\n\n2. Any statement which differs materially from the information\n\ncontained in a registration application or public offering\n\nstatement.\n\nB. All advertising except advertising relating to subdivided\n\nland or transactions exempt pursuant to Sections 622 and 623 shall\n\nbe filed with the Administrator not later than ten (10) days prior\n\nto its use and shall not be used until a copy thereof has been\n\napproved for use by the Administrator, except advertising which the\n\nAdministrator exempts by rule or order.
