Stat. tit. 71, § 71-813","heading":"Investigations and proceedings - Powers and duties of","body":"Administrator.\n\nA. The Administrator:\n\n1. May make such public or private investigations within or\n\noutside of this state as the Administrator deems necessary to\n\ndetermine whether any person has violated or is about to violate any\n\nprovision of the Oklahoma Business Opportunity Sales Act or any rule\n\nor order hereunder, or to aid in the enforcement of the act or in\n\nthe prescribing of rules and forms hereunder;\n\n2. May require or permit any person to file a statement, under\n\noath or otherwise as the Administrator determines, as to all the\n\nfacts and circumstances concerning the matter to be investigated;\n\nand\n\n3. May publish information concerning any violation of the\n\nOklahoma Business Opportunity Sales Act or any rule or order\n\nhereunder.\n\nB. For the purpose of any investigation or proceeding pursuant\n\nto the Oklahoma Business Opportunity Sales Act, the Administrator or\n\nthe Administrator’s designee may administer oaths and affirmations,\n\nsubpoena witnesses, compel their attendance, take evidence and\n\nrequire the production of any books, papers, correspondence,\n\nmemoranda, agreements or other documents or records which the\n\nAdministrator deems relevant or material to the inquiry.\n\nC. In case of contumacy by, or refusal to obey a subpoena\n\nissued to any person, the district court of Oklahoma County or the\n\ndistrict court in any other county where service can be obtained on\n\none or more of the defendants, upon application by the\n\nAdministrator, may issue to the person an order requiring him or her\n\nto appear before the Administrator, there to produce documentary\n\nevidence if so ordered or to give evidence touching upon the matters\n\nunder investigation or in question. Failure to obey the order of\n\nthe court may be punishable by the court as contempt.\n\nD. No person is excused from attending and testifying or from\n\nproducing any document or record before the Administrator or the\n\nAdministrator’s designee, or in obedience to the subpoena of the\n\nAdministrator or the Administrator’s designee, in any proceeding\n\ninstituted by the Administrator, on the grounds that the testimony\n\nor evidence, documentary or otherwise, required by the Administrator\n\nmay tend to incriminate him or her or subject him or her to a\n\npenalty or forfeiture; but no individual may be prosecuted or\n\nsubjected to any penalty or forfeiture on account of any\n\ntransaction, matter or thing concerning which he or she is\n\ncompelled, after claiming his or her privilege against self-\n\nincrimination, to testify or produce evidence, documentary or\n\notherwise, except that the individual testifying is not exempt from\n\nprosecution and punishment for perjury or contempt committed in\n\ntestifying.","path":["OK Code","Title 71"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os71.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f49875496357f8124b15685d4e25a3a159876aa150400e1119774b4f449a0098","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-71-71-812","next":"us-ok/okla.-stat.-tit.-71-71-814"},"notice":"GroundRules: Original legal text.
