The subject of the proceeding in a guardianship established\n\npursuant to the Veterans Volunteer Guardianship Act shall:\n\n1. Meet the requirements of \"veteran\" pursuant to Section 2 of\n\nTitle 72 of the Oklahoma Statutes;\n\n2. Be a resident of this state; and\n\n3. Be in receipt of a veteran's disability compensation or\n\npension from the United States Department of Veterans Affairs\n\npursuant to Title 38 of the Code of Federal Regulations or in\n\nreceipt of benefits under the Supplemental Nutrition Assistance\n\nProgram.\n\nB. The current or prospective guardian in a guardianship\n\nestablished pursuant to the Veterans Volunteer Guardianship Act\n\nshall:\n\n1. Be an individual;\n\n2. Be a resident of this state;\n\n3. Not be related by blood, adoption or marriage to the subject\n\nof the proceeding within the third degree of affinity or\n\nconsanguinity;\n\n4. Not be considered ineligible or barred from serving as a\n\nfiduciary for a veterans affairs beneficiary under Section 13.130 of\n\nTitle 38 of the Code of Federal Regulations; provided, that any\n\nguardian appointed under the Veterans Volunteer Guardianship Act\n\nthat is subsequently denied appointment as a fiduciary shall provide\n\nnotification to the court within thirty (30) days of receipt of\n\nnotice of the denial;\n\n5. Serve on a volunteer basis and waive compensation for\n\nservices as a guardian; provided, the guardian may receive\n\nreimbursement of expenses incurred on behalf of the subject of the\n\nproceeding that are authorized by court order and subject to the\n\nlimitations imposed by the court; and\n\n6. Be availed of any benefits and subject to any additional\n\nrequirements promulgated by rules or policy of the Oklahoma\n\nDepartment of Veteran Affairs, as the Department deems beneficial to\n\nthe recruitment of community volunteer guardians and protection of\n\nthe interest of the wards, including but not limited to background\n\nchecks.\n\nC. Nothing in this section shall be construed to prevent a\n\nguardian or prospective guardian from receiving compensation for\n\nservices as a fiduciary appointed by the United States Department of\n\nVeterans Affairs or as a court-ordered guardian that is otherwise\n\nauthorized under Title 30 of the Oklahoma Statutes and does not cite\n\nauthority or request benefits from the provisions of the Veterans\n\nVolunteer Guardianship Act.\n\nD.
