Stat. tit. 72, § 72-229.1","heading":"Authority to plan, develop and construct Oklahoma","body":"veterans facilities.\n\nA. The Oklahoma Department of Veterans Affairs is authorized to\n\nplan, develop and construct two long-term care facilities for the\n\nfollowing purposes:\n\n1. To assume the operations of the State Veterans Home\n\nestablished in Talihina pursuant to Section 229 of this title. In\n\naccordance with Section 229 of this title and Section 1 of this act,\n\nthe facility to assume operations of the State Veterans Home at\n\nTalihina shall be the State Veterans Home at Sallisaw, Oklahoma,\n\nestablished under Section 1 of this act; and\n\n2. To replace the State Veterans Home established in Ardmore\n\npursuant to Section 221 of this title.\n\nB. For the two long-term care facilities authorized in\n\nsubsection A of this section, the Department may construct new\n\nfacilities or refurbish any existing facilities on property\n\ncurrently owned by this state or on property purchased or donated\n\nfrom other sources including but not limited to private owners,\n\ntribal entities or other governmental or municipal entities.\n\nC. 1. The facility referenced in paragraph 1 of subsection A\n\nof this section shall be located within or near the corporate limits\n\nof the City of Sallisaw.\n\n2. The facility referenced in paragraph 2 of subsection A of\n\nthis section shall be located within the corporate limits of the\n\nCity of Ardmore or within five (5) miles of the corporate limits of\n\nthe City of Ardmore.\n\nD. The locations and sites of the two facilities referenced in\n\nsubsection A of this section shall be determined by the Oklahoma\n\nVeterans Commission, subject to such geographical constraints as are\n\nimposed by the United States Department of Veterans Affairs for\n\ncertification as a State Veterans Home. The Oklahoma Veterans\n\nCommission may consider any and all criteria which, in its sole\n\ndiscretion, further the interests of Oklahoma veterans.\n\nE. The project constituting the construction of the\n\nreplacement, long-term care facility for the Ardmore Veterans Home\n\nshall be exempt from the requirements of Sections 9030 through\n\n9030.8 of Title 74 of the Oklahoma Statutes.\n\nF. The proceeds received from the sale of the State Veterans\n\nHome in Talihina, along with all associated real and personal\n\nproperty, shall belong to the Oklahoma Department of Veterans\n\nAffairs and shall be used for any one or more of the following\n\npurposes:\n\n1. To purchase land upon which the replacement, long-term care\n\nfacility for the Ardmore Veterans Home will be located;\n\n2. To purchase any other personal property needed for the\n\nconstruction and furnishing of the replacement, long-term care\n\nfacility for the Ardmore Veterans Home;\n\n3. To fund operations of the State Veterans Home at Sallisaw;\n\nand\n\n4.
