The Oklahoma Department of Veterans Affairs shall establish\n\na program to provide assistance for the proper interment or\n\ncremation of honorably discharged indigent veterans of the United\n\nStates Armed Forces. The program shall aid in obtaining any\n\navailable burial benefits from the United States Department of\n\nVeterans Affairs or through private organizations. The program\n\nshall provide for a burial grant for any indigent veteran or any\n\nperson who qualifies for reimbursement as determined by the Oklahoma\n\nDepartment of Veterans Affairs, for unpaid expenses directly\n\nresulting from interment or cremation. Maximum reimbursement shall\n\nnot exceed One Thousand Dollars ($1,000.00) per indigent veteran\n\napplication.\n\nB. Eligibility requirements for the program shall be as\n\nfollows:\n\n1. The deceased shall be a veteran as defined by Section 2 of\n\nthis title;\n\n2. No one shall have claimed the remains of the deceased\n\nVeteran;\n\n3. The veteran shall have died in Oklahoma;\n\n4. The veteran shall not have been in the custody of the\n\nDepartment of Corrections at the time of death;\n\n5. The applicant shall provide documentation establishing the\n\nburial location of the deceased veteran's remains in a cemetery or\n\nthe location where the deceased veteran's cremains have been\n\npermanently placed; and\n\n6. The applicant shall provide documentation establishing that\n\nthe deceased veteran received a proper memorial headstone or marker\n\nat the place of his or her interment as provided for in Section 2306\n\nof Title 38 of the United States Code or that a memorial headstone\n\nor marker meeting the same physical standards for size, material,\n\ncomposition, placement and informational content was provided in the\n\nevent the deceased veteran did not qualify under the provisions of\n\nSection 2306 of Title 38 of the United States Code.\n\nC. The Executive Director of the Oklahoma Department of\n\nVeterans Affairs or his or her designee shall make final approval of\n\nIndigent Veteran Burial Applications, shall determine whether the\n\ndeceased meets eligibility criteria and may approve funds to\n\nreimburse the costs of interment or cremation.\n\nD. Reimbursement shall be paid from the Indigent Veteran Burial\n\nRevolving Fund. If there are insufficient resources in the Indigent\n\nVeteran Burial Revolving Fund, payment shall be made from the\n\nOklahoma Department of Veterans Affairs Revolving Fund.\n\nOnce funds are available in the Indigent Veteran Burial\n\nRevolving Fund, the Oklahoma Department of Veterans Affairs may be\n\nreimbursed for payments made from the Oklahoma Department of\n\nVeterans Affairs Revolving Fund.\n\nE. Application processes for the implementation of this program\n\nshall be developed by the Oklahoma Department of Veterans Affairs.\n\nF.
