This act shall be known and may be cited as the \"Dignity in\n\nBurial Act\".\n\nB. The Oklahoma Department of Veterans Affairs shall establish\n\na program to ensure a dignified burial for honorably discharged\n\nveterans of the United States Armed Forces who, prior to death,\n\nlacked the financial capacity to prepare for or to provide for an\n\ninterment or cremation befitting a veteran of the United States\n\nArmed Forces. The program shall aid in obtaining any available\n\nburial benefits from the United States Department of Veterans\n\nAffairs or through private organizations. The program shall provide\n\na burial grant for any veteran or any person who qualifies for\n\nreimbursement, as determined by the Oklahoma Department of Veterans\n\nAffairs, for unpaid expenses directly resulting from interment or\n\ncremation. The maximum amount of reimbursement, not including\n\nprivate funds, shall not exceed One Thousand Dollars ($1,000.00) per\n\napplication.\n\nC. Eligibility requirements for the program shall be as\n\nfollows:\n\n1. The deceased shall be a veteran as defined in Section 2 of\n\nTitle 72 of the Oklahoma Statutes;\n\n2. The veteran shall have died in Oklahoma;\n\n3. The veteran shall not have been in the custody of the\n\nDepartment of Corrections at the time of death;\n\n4. The applicant shall provide documentation establishing the\n\nburial location of the deceased veteran's remains in a cemetery or\n\nthe location where the deceased veteran's cremains have been\n\npermanently placed;\n\n5. The applicant shall provide documentation establishing that\n\nthe deceased veteran was provided an appropriate casket if the\n\ndeceased veteran was interred; and\n\n6. The applicant shall provide documentation establishing that\n\nthe deceased veteran received a proper memorial headstone or marker\n\nat the place of his or her interment as provided in 38 U.S.C.,\n\nSection 2306 or that a memorial headstone or marker meeting the same\n\nphysical standards for size, material, composition, placement, and\n\ninformational content was provided in the event the deceased veteran\n\ndid not qualify under the provisions of 38 U.S.C., Section 2306.\n\nD. The Executive Director of the Oklahoma Department of\n\nVeterans Affairs or his or her designee shall make final approval of\n\nthe Dignity in Burial Act applications, shall determine whether the\n\ndeceased meets eligibility criteria, and may approve funds to\n\nreimburse the costs of interment or cremation.\n\nE. Reimbursement shall be paid from the Indigent Veteran Burial\n\nRevolving Fund provided in Section 34 of Title 72 of the Oklahoma\n\nStatutes. If there are insufficient resources in the Indigent\n\nVeteran Burial Revolving Fund, payment shall be made from the\n\nOklahoma Department of Veterans Affairs Revolving Fund.\n\nF. An application process for the implementation of this\n\nprogram shall be developed by the Oklahoma Department of Veterans\n\nAffairs.\n\nG.
