Stat. tit. 72, § 72-48","heading":"Leave of absence during active or inactive duty or service","body":"- Public employees.\n\nA. All officers and employees of the state or a political\n\nsubdivision thereof who are members, either officers or enlisted, of\n\nthe state military forces or any branch of the United States\n\nMilitary or its reserve components, shall, when ordered by the\n\nproper authority to active or inactive duty or service, including\n\nstate active duty, be entitled to a leave of absence from such\n\ncivilian employment for the period of such service without loss of\n\nstatus or seniority. During the first thirty (30) regularly\n\nscheduled work days for officers and employees of the State of\n\nOklahoma or a political subdivision thereof, or not to exceed two\n\nhundred forty (240) hours, of such leave of absence in any federal\n\nfiscal year, the officers or employees shall receive their full\n\nregular pay from the employing state agency or political\n\nsubdivision. During the remainder of such leave of absence in any\n\nfederal fiscal year, the employing state agency or political\n\nsubdivision shall pay the officer or employee an amount equal to the\n\ndifference between his or her full regular pay from the employing\n\nstate agency or political subdivision and his or her military base\n\npay. Military allowances and entitlements not subject to federal\n\ntaxation shall not be included in the computation of the difference\n\nbetween the full regular pay of the officers or employees from the\n\nemploying state agency or political subdivision and their Oklahoma\n\nNational Guard or United States military reserve component military\n\nbase pay. The durational limit of protected military service as\n\nprovided for in this section shall not be less than that provided by\n\nfederal law. If it is necessary in the public interest to provide\n\nfor the performance of the duties of their positions during such\n\nabsence, the authority having power to fill a vacancy in the\n\npositions may appoint substitutes, to be known as acting incumbents,\n\nwho shall qualify as required for the regular incumbents and shall\n\nreceive the same pay, including benefits and pay adjustments as\n\nfixed by law, if any, or otherwise such pay, including benefits and\n\npay adjustments, as may be fixed by proper authority.\n\nB. The Office of Management and Enterprise Services shall\n\npromulgate rules as necessary to implement the provisions of this\n\nsection that relate to state employees.\n\nC.
