All officers and employees of any employer in the private\n\nsector, who are members, either officers or enlisted, of the Reserve\n\nComponents of the Army, Navy, Air Force, Marine Corps, and Coast\n\nGuard, or any other component of the Uniformed Services of the\n\nUnited States, shall, when ordered by the proper authority to active\n\nor inactive duty or service under Title 10 of the United States\n\nCode, be entitled to a leave of absence from such private civilian\n\nemployment for the period of such service without loss of status or\n\nseniority. During such leave of absence in any federal fiscal year,\n\nthe employer in the private sector may elect to pay the officer or\n\nemployee an amount equal to the difference between his or her full\n\nregular pay from the employer in the private sector and his or her\n\nmilitary base pay. The durational limit of protected military\n\nservice as provided for in this section shall not be less than that\n\nprovided by federal law.\n\nIf any employer in the private sector fails to comply with the\n\nprovisions of this subsection, the officer or employee may bring an\n\naction in district court for the same remedies and damages provided\n\nfor in Section 17 of this act, for such noncompliance and may be\n\ngranted such relief as is just and proper under the circumstances.\n\nB. All officers and employees of any employer in the private\n\nsector, who are members, either officers or enlisted, of the state\n\nmilitary forces, shall, when ordered by the proper authority to\n\nstate active duty or Title 32 active duty, be entitled to all the\n\nprotections provided under the Oklahoma Uniformed Services\n\nEmployment and Reemployment Rights Act.\n\nC. \"State active duty\", \"state military forces\", and \"Title 32\n\nactive duty\", for the purposes of this section, shall be defined in\n\naccordance with Section 801 of Title 44 of the Oklahoma Statutes.","path":["OK Code","Title 72"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os72.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"491b0a62ff516ade836b0f6db627e5baf96c91cb865d284f0b6c990048ecd97e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-72-72-48","next":"us-ok/okla.-stat.-tit.-72-72-48.2"},"notice":"GroundRules: Original legal text.
