Stat. tit. 74, § 74-1108a","heading":"Establishment of boundaries for planning regions","body":"(1) It shall be the duty of the Oklahoma Industrial Development\n\nand Park Commission to establish criteria for boundaries of planning\n\nregions within the state in the following manner:\n\n(a) The Director shall within six (6) months after the\n\neffective date of this act recommend to the Commission proposed\n\ncriteria to be used in the establishment of planning regions;\n\n(b) The Commission shall within three (3) months after the date\n\nof submission of the criteria by the Director establish and adopt\n\ncriteria to be used in the delineation of planning regions following\n\nat least one public hearing with notice to all regional planning\n\nagencies, counties and municipalities included therein.\n\n(2) The Commission shall establish boundaries for planning\n\nregions in the following manner:\n\n(a) Based upon criteria adopted by the Commission the Director\n\nshall within thirty (30) days recommend to the Commission planning\n\nregional boundaries;\n\n(b) The Commission shall within sixty (60) days after the\n\nDirector's recommendation adopt and establish planning regional\n\nboundaries following at least one public hearing with notice to all\n\nregional planning agencies, counties and municipalities included\n\ntherein.\n\n(3) Any regional planning agency may, within forty-five (45)\n\ndays after a final decision of the Commission on delineation of\n\nplanning regional boundaries, file an appeal in writing to the\n\nGovernor with a copy to the Commission. In the event of such appeal\n\nthe Governor may approve or modify the decision of the Commission.\n\n(4) When any two or more regional planning agencies shall\n\npropose to the Director in writing a modification of existing\n\nboundaries, the Director shall within thirty (30) days after receipt\n\nof such request forward said request with his recommendations to the\n\nCommission which shall conduct a public hearing with notice to the\n\nregional planning agencies, counties and municipalities affected\n\ntherein before final action on such request.\n\n(5) The Commission may delegate to the Director the holding of\n\npublic hearings as required by this section, in which case the full\n\nproceedings of the hearing shall be transcribed and transmitted to\n\nthe Commission.\n\n(6) Where a Standard Metropolitan Statistical Area (SMSA), as\n\ndetermined by the Federal Office of Management and Budget, crosses\n\nthe state line and includes counties both from Oklahoma and another\n\nstate, the regional and areawide planning covering the Oklahoma\n\ncounties shall be the sole responsibility of the Oklahoma Regional\n\nPlanning Agency established for the area delineated in accordance\n\nwith this section, and not a regional organization operating across\n\nthe state line. The Oklahoma Regional Planning Agency shall have\n\nthe sole responsibility for determining eligibility and for clearing\n\nall grants and all projects.\n\n(7) As used in this section:\n\n(a) \"Regional planning agency\" means an agency of state\n\ngovernment or other entity which has planning responsibilities for\n\ntwo or more counties; and\n\n(b) \"Notice\" means written notifications at least fifteen (15)\n\ndays prior to public hearing.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"eb791181e5478934c0a009fb3b01b86dbbc943cb2a71a44bc52e28ae2dae825d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-11000","next":"us-ok/okla.-stat.-tit.-74-74-111"},"notice":"GroundRules: Original legal text.
