As used in this section only of the Energy Discrimination\n\nElimination Act of 2022, \"governmental entity\" means a state agency\n\nor political subdivision of this state.\n\nB. 1. Except for paragraph 4 of this subsection, this section\n\napplies only to a contract that:\n\na. is between a governmental entity and a company with\n\nten or more full-time employees, and\n\nb. will pay a company One Hundred Thousand Dollars\n\n($100,000.00) or more over the term of the contract\n\nthat is to be paid wholly or partly from public funds\n\nof the governmental entity; provided, however, the\n\nprovisions of this paragraph shall apply separately to\n\nall companies in a multiple party contract.\n\n2. Except as provided by paragraph 4 of this subsection, a\n\ngovernmental entity shall not enter into a contract with a company\n\nfor goods or services unless the contract contains a written\n\nverification from the company that it:\n\na. does not boycott energy companies, and\n\nb. will not boycott energy companies during the term of\n\nthe contract.\n\n3. Except as provided by paragraph 4 of this subsection, a\n\ngovernmental entity shall not enter into a contract for goods or\n\nservices with a listed financial company under Section 3 of this\n\nact.\n\n4. Paragraphs 2 and 3 of this subsection shall not apply to:\n\na. a governmental entity that determines the requirements\n\nof paragraphs 2 or 3 of this subsection are\n\ninconsistent with the governmental entity's\n\nconstitutional or statutory duties related to the\n\nissuance, incurrence, or management of debt\n\nobligations or the deposit, custody, management,\n\nborrowing, or investment of funds, and\n\nb. a contract for which a governmental body determines\n\nthe supplies or services to be provided are not\n\notherwise reasonably available from a company that is\n\nnot a listed financial company under Section 3 of this\n\nact.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b8240e5d5cb422a3186877fbaa8c91499e24a091c4e0b616e10cddb29a76c168","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-12004","next":"us-ok/okla.-stat.-tit.-74-74-12006"},"notice":"GroundRules: Original legal text.
