Stat. tit. 74, § 74-1221","heading":"Indian tribes - Acknowledgment of federal recognition -","body":"Cooperative agreements - Surface water and/or groundwater resources.\n\nA. The State of Oklahoma acknowledges federal recognition of\n\nIndian tribes recognized by the Department of Interior, Bureau of\n\nIndian Affairs.\n\nB. The State of Oklahoma recognizes the unique status of Indian\n\ntribes within the federal government and shall work in a spirit of\n\ncooperation with all federally recognized Indian tribes in\n\nfurtherance of federal policy for the benefit of both the State of\n\nOklahoma and tribal governments.\n\nC. 1. The Governor is authorized to negotiate and enter into\n\ncooperative agreements on behalf of this state with federally\n\nrecognized Indian tribal governments within this state to address\n\nissues of mutual interest. The Governor may elect to name a\n\ndesignee who shall have authority to negotiate and enter into\n\ncooperative agreements on behalf of the state with federally\n\nrecognized Indian tribes as provided for in this section. Except as\n\notherwise provided by this subsection, such agreements shall become\n\neffective upon approval by the Joint Committee on State-Tribal\n\nRelations.\n\n2. If the cooperative agreements specified and authorized by\n\nparagraph 1 of this subsection involve trust responsibilities,\n\napproval by the Secretary of the Interior or designee shall be\n\nrequired.\n\n3. Any cooperative agreement specified and authorized by\n\nparagraph 1 of this subsection involving the surface water and/or\n\ngroundwater resources of this state or which in whole or in part\n\napportions surface and/or groundwater ownership shall become\n\neffective only upon the consent of the Oklahoma Legislature\n\nauthorizing such cooperative agreement.\n\nD. 1. The governing board of a political subdivision of this\n\nstate is authorized to negotiate and enter into intergovernmental\n\ncooperative agreements in behalf of the political subdivision, with\n\na federally recognized Indian tribal government within this state to\n\naddress issues of mutual interest. Except as otherwise provided by\n\nthis subsection, such agreements shall be effective upon approval by\n\nthe Joint Committee on State-Tribal Relations and the Governor, or\n\nthe designee of the Governor.\n\n2. Agreements for juvenile detention facilities made pursuant\n\nto Section 2-3-103 of Title 10A of the Oklahoma Statutes shall\n\nbecome effective upon approval by the board of county commissioners.\n\n3. Any cooperative agreement specified and authorized by\n\nparagraph 1 of this subsection involving the surface water and/or\n\ngroundwater resources of this state shall become effective only upon\n\nthe consent of the Oklahoma Legislature authorizing such cooperative\n\nagreement.\n\n4. Agreements between the Military Department of the State of\n\nOklahoma and an Indian tribe for the management or operation of a\n\njuvenile facility shall not be subject to the requirements of this\n\nsection.\n\n5. Agreements between the Department of Transportation of the\n\nState of Oklahoma and an Indian tribe or the Oklahoma Turnpike\n\nAuthority and an Indian tribe for the maintenance and construction\n\nof transportation facilities, roads or bridges shall not be subject\n\nto the requirements of this section.\n\nE. An executed original of every agreement approved pursuant to\n\nthis section shall be filed with the Secretary of State.
