There is hereby created in the State Treasury a revolving\n\nfund for the Office of Management and Enterprise Services to be\n\ndesignated the \"State-Tribal Litigation Revolving Fund\". The fund\n\nshall be a continuing fund, not subject to fiscal year limitations,\n\nand shall consist of all monies designated for deposit by law. All\n\nmonies accruing to the credit of said fund are hereby appropriated\n\nand may be budgeted and expended, as otherwise provided in this act,\n\nby the Office of Management and Enterprise Services for the purpose\n\nof hiring legal counsel and paying legal expenses of the state\n\nrelated to legal controversies between the State of Oklahoma and\n\ntribal governments.\n\nB. Expenditures from said fund shall only be made for legal\n\nservices relating to cases and controversies that the Joint\n\nCommittee on State-Tribal Relations, (created pursuant to Section\n\n1222 of Title 74 of the Oklahoma Statutes), has formally recommended\n\nthe State of Oklahoma pursue or litigate.\n\nC. Expenditures from said fund for the reimbursement of\n\nservices by third-party legal counsel shall only be made if the\n\ncontract for such services was formally approved by the Joint\n\nCommittee on State-Tribal Relations, (created pursuant to Section\n\n1222 of Title 74 of the Oklahoma Statutes), prior to the performance\n\nof such services.\n\nD. Expenditures from said fund shall be made upon warrants\n\nissued by the State Treasurer against claims filed as prescribed by\n\nlaw with the Director of the Office of Management and Enterprise\n\nServices for approval and payment.\n\nE. If any of the provisions of this section are determined by a\n\ncourt of competent jurisdiction to be unconstitutional, any\n\nunexpended balance remaining in the State-Tribal Litigation\n\nRevolving Fund created pursuant to this section shall revert to the\n\nGeneral Revenue Fund of this state and shall be used for general\n\nexpenses of state government to be paid out pursuant to direct\n\nappropriation of the Legislature.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2db41437576cac920eb824d7b7c2e210be892256f7ea67b8662f1340da24fba0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-1222","next":"us-ok/okla.-stat.-tit.-74-74-1223"},"notice":"GroundRules: Original legal text.
