Stat. tit. 74, § 74-1226.3","heading":"Definitions","body":"As used in Sections 1226 through 1226.16 of this title:\n\n1. \"Authority\" shall mean the Native American Cultural and\n\nEducational Authority, created by Section 1226.2 of this title, or,\n\nif such Authority shall be abolished, the board, body, or commission\n\nsucceeding to the principal functions hereof or to whom the powers\n\ngiven by Section 1226 et seq. of this title shall be given by law;\n\n2. \"Project\" or \"projects\" shall mean any facilities\n\nconstructed or improvements made under the provisions of this act by\n\nthe Authority for the purpose of constructing a Native American\n\ncultural center, museum and theme park, to also include commercial\n\nfacilities as herein defined, and shall embrace all buildings,\n\nstructures, landscaping, infrastructure, utilities, roadways,\n\nparking structures, parking lots, sidewalks, personal property and\n\nfixtures, equipment and machinery, and other improvements which the\n\nAuthority may deem necessary for the operation of such projects,\n\ntogether with all property, rights, easements and interests which\n\nmay be acquired by the Authority for the construction or the\n\noperation of such;\n\n3. “Commercial facilities” shall mean facilities, including,\n\nbut not limited to, conference centers, hotels, motels, recreational\n\nvehicle parks, festival marketplaces, restaurants, retail sales\n\nfacilities, studios and other facilities for the design, development\n\nand manufacture of Native American art, crafts and cultural objects,\n\nand uses related thereto and other supporting, complementary and\n\nancillary uses;\n\n4. \"Cost\" as applied to a project shall include expenditures of\n\nthe Authority, other governmental agencies, and private entities, to\n\ninclude past, present and future expenditures, and shall embrace the\n\ncost of construction, the cost of the acquisition of all land,\n\nrights-of-way, property, rights, easements and interests acquired by\n\nthe Authority for such construction, the cost of all machinery and\n\nequipment, financing charges, provision for working capital,\n\ninterest prior to, during, and after construction and a reserve for\n\ninterest in such amounts as the Authority shall determine, cost of\n\nengineering, architecture, planning, legal and accounting expenses,\n\nplans, specifications, surveys, estimates of cost, and of revenues,\n\nother expenses necessary or incident to determining the feasibility\n\nor practicability of constructing any such project, administrative\n\nexpense, and such other expense as may be necessary or incident to\n\nthe construction of the project, the financing of such construction,\n\nand the placing of the project in operation, and other expenditures\n\nin furtherance of the objectives of Sections 1226 through 1226.16 of\n\nthis title;\n\n5. \"Owner\" shall include all individuals, copartnerships,\n\nassociations, corporations, trusts, and any other person or entity\n\nhaving any title or interest in any property, rights, easements, and\n\ninterests authorized to be acquired by Sections 1226 through 1226.16\n\nof this title;\n\n6. The phrase \"operational services\" shall mean services of a\n\nmaintenance or operational nature, including, but not limited to,\n\ngrounds maintenance and security services, provided by the\n\nAuthority, pursuant to an agreement between the Authority and any\n\nservice recipient; and\n\n7.
