Stat. tit. 74, § 74-123f","heading":"Convict-made goods - Sale or distribution prohibited -","body":"Exceptions.\n\nNo products, wares, or merchandise produced, manufactured, or\n\nmined, wholly or in part, by convicts or prisoners of this state,\n\nwho are employed in the state prison industries program, may be\n\noffered for sale, sold, exchanged, or distributed in this state,\n\nwhether contained in the original package or otherwise. This\n\nsection shall not prohibit the sale or distribution of such\n\nproducts, wares, or merchandise by or for the state to departments,\n\ninstitutions, or agencies administered and supported by the state or\n\nits political subdivisions, and any other wholly or partially tax-\n\nsupported institutions, or nonprofit charitable agencies for\n\ndistribution to the needy. This section shall not prohibit the sale\n\nor distribution of such products, wares, or merchandise produced by\n\nOklahoma Correctional Industries or products produced by the Agri-\n\nServices Division of the Department of Corrections by or for sale to\n\nemployees or retirees of the State of Oklahoma, or to employees or\n\nretirees of any political subdivision of the state. This section\n\nshall not prohibit the sale or distribution of housing components\n\nproduced by Oklahoma Correctional Industries by or for sale to any\n\ncommunity action agency or council of governments within this state.\n\nThis section shall not prohibit the sale of brick and building tile\n\nor furniture manufactured by said state institutions to churches\n\nwhich are located in the State of Oklahoma. All purchase orders\n\nmade pursuant to the provisions of this section for such brick or\n\nbuilding tile or furniture shall contain an affidavit stating that\n\nthe brick or building tile shall not be used for purposes other than\n\nfor the building of churches, or that the furniture shall not be\n\nused for any purpose other than church purposes. If said state\n\ndepartments, institutions, agencies, or nonprofit charitable\n\nagencies do not buy or contract to buy in advance of the season for\n\nwhich said wares or goods are made, and make a satisfactory\n\nguarantee to the Office of Management and Enterprise Services for\n\nfulfillment of their contract to purchase all the output, the state\n\nmay then sell in open market any such goods or wares not generally\n\nmanufactured in this state. The provisions of this section shall\n\nnot apply to the sale or distribution of surplus perishable,\n\nagricultural products nor to individual articles made by hand by\n\nprisoners during their leisure time.
