Stat. tit. 74, § 74-1303","heading":"Definitions","body":"For the purposes of and as used in the Oklahoma Employees\n\nInsurance and Benefits Act:\n\n1. \"Board\" means the Oklahoma Employees Insurance and Benefits\n\nBoard as created by the Oklahoma Employees Insurance and Benefits\n\nAct;\n\n2. \"Plan\" means the Oklahoma Employees Insurance Plan;\n\n3. \"Employee\" means those state employees, education employees\n\nand other eligible employees participating in the Oklahoma Employees\n\nInsurance and Benefits Act;\n\n4. \"Education employee\" means those employees other than\n\nadjunct professors employed by a state institution of higher\n\neducation, in the service of an education entity who are members or\n\nare or will be eligible to become members of the Teachers’\n\nRetirement System of Oklahoma and who receive compensation for such\n\nservice after the education entity begins to participate in the\n\nOklahoma Employees Insurance and Benefits Act and visiting faculty\n\nwho are not eligible for membership in the Teachers’ Retirement\n\nSystem of Oklahoma;\n\n5. \"Adjunct professor\" means a person employed by an\n\ninstitution of higher education who is attached in a subordinate or\n\ntemporary capacity to the faculty or staff, and who is contracted to\n\ninstruct in a given specific discipline;\n\n6. \"Visiting faculty\" means a person employed by an institution\n\nof higher education who is not eligible for academic rank or tenure,\n\nother than an adjunct professor, and who is contracted to instruct\n\nin a given specific discipline generally not to exceed one (1)\n\nacademic year;\n\n7. \"Education entity\" means a school district, a technology\n\ncenter school district, or an institution comprising The Oklahoma\n\nState System of Higher Education;\n\n8. \"State employee\" means and includes each officer or employee\n\nin the service of the State of Oklahoma who, after January 1, 1966,\n\nreceived compensation for service rendered to the State of Oklahoma\n\non a warrant issued pursuant to a payroll certified by a department\n\nor by an elected or duly appointed officer of the state or who\n\nreceives payment for the performance of personal services on a\n\nwarrant issued pursuant to a payroll certified by a department and\n\ndrawn by the State Treasurer against appropriations made by the\n\nLegislature from any state fund or against trust funds held by the\n\nState Treasurer, who is employed in a position normally requiring\n\nactual performance of duty during not less than one thousand (1,000)\n\nhours per year, and whose employment is not seasonal or temporary,\n\nexcept that a person elected by popular vote will be considered an\n\nemployee during the person’s tenure in office; provided, however,\n\nthat employees who are otherwise eligible who are on approved leave\n\nwithout pay shall be eligible to continue coverage during such leave\n\nnot to exceed twenty-four (24) months, as provided and published in\n\nthe Office of Management and Enterprise Services Rules for\n\nEmployment, from the date the employee goes on such leave provided\n\nthe employee pays the full premiums due or persons who are drawing\n\ndisability benefits under the State Employees Disability Program Act\n\nor meet each and every requirement of the State Employees Disability\n\nProgram shall be eligible to continue coverage provided the person\n\npays the full premiums due;\n\n9. \"Carrier\" means the State of Oklahoma or a state designated\n\nHealth Maintenance Organization (HMO). Such HMO shall be a\n\nfederally qualified Health Maintenance Organization under 42 U.S.C.,\n\nSection 300e et seq.;\n\n10. \"Health insurance plan\" means a self-insured plan by the\n\nState of Oklahoma for the purpose of paying the cost of hospital and\n\nmedical care up to the maximum coverage provided by said plan or\n\nprepaid medical plan(s) offered to employees as an alternative to\n\nthe state-administered plan by federally qualified HMOs which have\n\ncontracted with the state;\n\n11. \"Life insurance plan\" means a self-insured plan for the\ne plan\" means a self-insured plan by the\n\nState of Oklahoma for the purpose of paying the cost of hospital and\n\nmedical care up to the maximum coverage provided by said plan or\n\nprepaid medical plan(s) offered to employees as an alternative to\n\nthe state-administered plan by federally qualified HMOs which have\n\ncontracted with the state;\n\n11. \"Life insurance plan\" means a self-insured plan for the\n\npurpose of paying death and dismemberment benefits up to the maximum\n\ncoverage provided by the plan;\n\n12. \"Dental benefits plan\" means a plan by the State of\n\nOklahoma for the purpose of paying the cost of dental care up to the\n\nmaximum coverage provided by the plan; whenever the term \"dental\n\ninsurance plan\" or a term of like import appears in the Oklahoma\n\nEmployees Insurance and Benefits Act, the term shall mean \"dental\n\nbenefits plan\";\n\n13. \"Other insurance\" means any type of coverage other than\n\nbasic hospital and medical benefits, major medical benefits,\n\ncomprehensive benefits, life insurance benefits or dental insurance\n\nbenefits, which the Plan may be directed to offer;\n\n14. \"Dependent\" means an employee’s spouse or any unmarried\n\nchild:\n\na. under the age of twenty-five (25) years, regardless of\n\nresidence, provided that the employee is primarily\n\nresponsible for their support, including:\n\n(1) an adopted child, and\n\n(2) a stepchild or child who lives with the employee\n\nin a regular parent-child relationship, or\n\nb. regardless of age who is incapable of self-support\n\nbecause of mental or physical incapacity that existed\n\nprior to reaching the age of twenty-five (25) years;\n\n15. \"Comprehensive benefits\" means benefits which reimburse the\n\nexpense of hospital room and board, other hospital services, certain\n\noutpatient expenses, maternity benefits, surgical expense, including\n\nobstetrical care, in-hospital medical care expense, diagnostic\n\nradiological and laboratory benefits, physicians’ services provided\n\nby house and office calls, treatments administered in physicians’\n\noffice, prescription drugs, psychiatric services, Christian Science\n\npractitioners’ services, Christian Science nurses’ services,\n\noptometric medical services for injury or illness of the eye, home\n\nhealth care, home nursing service, hospice care, and such other\n\nbenefits as may be determined by the Board. Such benefits shall be\n\nprovided on a copayment or coinsurance basis, the insured to pay a\n\nproportion of the cost of such benefits, and may be subject to a\n\ndeductible that applies to all or part of the benefits as determined\n\nby the Board; and\n\n16. \"Life insurance coverage\" shall include a maximum amount of\n\nbasic life insurance or benefit with or without a double indemnity\n\nprovision and an amount of accidental death and dismemberment\n\ninsurance or benefit per employee to be provided by the State of\n\nOklahoma, and the employee shall have the option to purchase\n\nadditional life insurance or benefits on the employee’s life up to\n\nthe amount provided by the plan. Such basic life insurance\n\nbenefits, with or without double indemnity, and accidental death and\n\ndismemberment benefits shall not exclude coverage for death or\n\ndismemberment resulting from war, insurrection or riot. The Board\n\nmay also extend dependent life insurance in an amount to be\n\ndetermined by the Board to each insured employee who elects to\n\ninsure the employee’s eligible dependents.
