The Oklahoma Health Care Authority shall have the right of\n\nsubrogation to recover any payments made for injury to an employee\n\nor dependent caused by a third party's wrongful act or negligence.\n\nThe Authority shall have the authority to waive or reduce\n\nsubrogation in individual cases when the exercise of the right of\n\nsubrogation would create an extreme financial hardship on the\n\nemployee or dependent.\n\nB. Subrogation will exist only to the extent of actual claims\n\npaid.\n\nC. If an employee or dependent has prejudiced the Authority's\n\nright of subrogation by releasing the responsible party prior to\n\nsubmitting claims to the Authority, the claims may be denied by the\n\nAuthority.
