Stat. tit. 74, § 74-1308.1","heading":"Educational entities - Extension of health, dental and","body":"life insurance plans.\n\n(1) An educational entity may extend the benefits of the health\n\ninsurance plan, the dental insurance plan, and the life insurance\n\nplan to education employees employed by the entity. The benefits of\n\nthe plans for an education employee shall be the same and shall\n\ninclude the same plan options as would be made available to a state\n\nemployee participating in the plan that resided at the same\n\nlocation. Notwithstanding the provisions of Section 1308.2 of this\n\ntitle, a period shall exist for enrolling education entities from\n\nApril 1, 1989 through October 1, 1991, whereby education employees\n\nof a participating education entity may be enrolled, pursuant to\n\nthis act, during the entities' initial enrollment period, regardless\n\nof preexisting conditions. The Oklahoma Health Care Authority shall\n\nadopt rules and regulations for enrollment by which education\n\nentities may apply to participate in the insurance plans. Once an\n\neducation entity becomes a participant in the health and dental\n\ninsurance plans offered through the Oklahoma Employees Insurance and\n\nBenefits Act, the education entity may withdraw from participation,\n\nin a manner prescribed by the Authority. If a school district is\n\nparticipating in the health and dental insurance plans pursuant to\n\nthe Oklahoma Employees Insurance and Benefits Act, Sections 1301\n\nthrough 1329 of this title, the employees of the school district who\n\nare eligible to participate in the health and dental plans, at such\n\ntime as the school district may withdraw from such participation,\n\nmay require the board of education of the school district to call an\n\nelection to allow the employees to vote as to whether the school\n\ndistrict shall continue participation in the health and dental\n\ninsurance plans offered through the Oklahoma Employees Insurance and\n\nBenefits Act. Upon the filing with the board of education of a\n\npetition calling for such an election which is signed by no less\n\nthan thirty percent (30%) of the eligible employees of the school\n\ndistrict, the board of education shall call an election for the\n\npurpose of determining whether the school district shall continue\n\nparticipation in the health and dental insurance plans offered\n\nthrough the Oklahoma Employees Insurance and Benefits Act. The\n\nelection shall be held within thirty (30) days of the filing of the\n\npetition. If a majority of those eligible employees voting at the\n\nelection vote to continue participation in the health and dental\n\ninsurance plans offered through the Oklahoma Employees Insurance and\n\nBenefits Act, the board of education shall be prohibited from\n\nwithdrawing the school district from such participation. If a\n\nmajority of those eligible employees voting at the election vote\n\nagainst continued participation in the health and dental insurance\n\nplans offered through the Oklahoma Employees Insurance and Benefits\n\nAct, the board of education of the school district shall apply to\n\ndiscontinue such participation within thirty (30) days of the\n\nelection and within the times the school district is authorized to\n\nwithdraw from participation in accordance with rules established for\n\nwithdrawal by the Authority.\n\n(2) Except as otherwise provided in this subsection, when an\n\neducation entity participates in the health and dental insurance\n\nplans offered through the Oklahoma Employees Insurance and Benefits\n\nAct, all employees shall be advised of health maintenance\n\norganizations (HMO) prepaid plans available as an alternative to the\n\nstate self-insured health insurance plan. Eligible part-time\n\neducation employees, at the option of the employee, may enroll in\n\nthe plans either at the time the education entity begins\n\nparticipation in the plans or, if later, upon a showing of\n\ninsurability to the satisfaction of the Authority.\ne advised of health maintenance\n\norganizations (HMO) prepaid plans available as an alternative to the\n\nstate self-insured health insurance plan. Eligible part-time\n\neducation employees, at the option of the employee, may enroll in\n\nthe plans either at the time the education entity begins\n\nparticipation in the plans or, if later, upon a showing of\n\ninsurability to the satisfaction of the Authority.\n\n(3) Any employee of an education entity participating in the\n\nhealth and dental insurance plans offered through the Oklahoma\n\nEmployees Insurance and Benefits Act who is employed after the\n\neducation entity began said participation may be enrolled in the\n\nhealth and dental insurance plans or HMO plans approved by the\n\nAuthority on the first day of the second month of employment.\n\n(4) Upon initial enrollment of an institution of higher\n\neducation to participate in the health and dental insurance plans\n\noffered through the Oklahoma Employees Insurance and Benefits Act,\n\nall individuals presently insured by said institution's present\n\ngroup health insurance plan shall become enrolled in said state\n\nplans for the remaining period of said institution's contractual\n\nliabilities.\n\n(5) Education employees who shall be absent from the teaching\n\nservice because of election or appointment as a local, state, or\n\nnational education association officer shall be allowed to retain\n\ncoverage pursuant to the Oklahoma Employees Insurance and Benefits\n\nAct upon the payment of the full cost of the coverage at the rate\n\nand under such terms and conditions established by the Authority.\n\n(6) Except as otherwise provided by law, an educational entity\n\nmay cease to participate in the Oklahoma Employees Insurance and\n\nBenefits Act but provide health insurance coverage through another\n\ninsurance carrier. The subsequent carrier shall provide coverage to\n\nthe employees of the educational entity who terminated employment\n\nwith a retirement benefit, with a vested benefit, or who have ten\n\n(10) or more years of service with a participating educational\n\nentity but did not have a vested benefit through the retirement\n\nsystem of the educational entity, if the election to retain health\n\ninsurance coverage was made within thirty (30) days of termination\n\nof employment.
