Stat. tit. 74, § 74-1314.3","heading":"Supplemental benefits - Transfer to State Plan -","body":"Employer contributions - Preexisting conditions - Satisfaction of\n\ndeductible - Dental and life insurance plans.\n\n(1) All otherwise eligible employees hired by the Oklahoma\n\nEmployment Security Commission after May 30, 1990, shall participate\n\nin the state plan and shall not be entitled to the supplemental\n\nhealth insurance for which provision is made in the Oklahoma\n\nEmployees Insurance and Benefits Act nor to any other Commission\n\nbenefit plan not generally available to state employees, and no\n\nother provisions of this act shall apply to such future hirees.\n\n(2) All otherwise eligible Commission employees not\n\nparticipating in the agency plan as of May 30, 1990, shall be\n\nenrolled in the state plan on July 1, 1990. Said nonparticipating\n\nCommission employees shall not be entitled to the supplemental\n\nhealth insurance for which provision is made in this act.\n\n(3) All Commission employees, retirees and dependents\n\nparticipating in the agency plan as of May 30, 1990, shall be\n\npermitted to transfer to the state plan and receive the supplemental\n\ninsurance benefits for which provision is made in Section 1314.4 of\n\nthis title at such time as the supplemental insurance is available.\n\nIf not sooner transferred, all agency plan participants shall be\n\ntransferred to the state plan on January 1, 1991. Such mandatory\n\ntransfer shall occur simultaneously with any cancellation by the\n\ninsurance provider of the agency plan, occurring prior to January 1,\n\n1991.\n\n(4) All Commission employees, retirees and dependents enrolling\n\nin or transferring to the state plan under the provisions of this\n\nsection shall be given the opportunity to participate in all options\n\nunder the state plan at the time of their enrollment or transfer.\n\n(5) For active employees of the Commission, the Commission\n\nshall pay the same monthly premium toward employee-only coverage as\n\nthat set by the Oklahoma Health Care Authority and approved by the\n\nOffice of Management and Enterprise Services and paid by the other\n\nstate agencies participating in the state health insurance program.\n\nFor retirees of the Commission who retired pursuant to the\n\nprovisions of the Oklahoma Public Employees Retirement System, the\n\nOklahoma Public Employees Retirement System shall pay the same\n\nmonthly contribution towards premiums for regular or Medicare\n\nsupplement health insurance coverage for those retirees as the\n\namount paid towards the premiums for the Oklahoma Public Employees\n\nRetirement System retirees from other agencies. For retirees of the\n\nCommission who retired under the provisions of another retirement\n\nplan, the Commission shall pay the same monthly contribution towards\n\npremiums for regular or Medicare supplement health insurance\n\ncoverage for those retirees as the amount paid towards premiums by\n\nthe Oklahoma Public Employees Retirement System for retirees of\n\nother state agencies.\n\n(6) Except as provided in this subsection, employees and\n\nretirees of the Commission, and their dependents, shall be covered\n\nunder the dental and life insurance plans provided by the Oklahoma\n\nHealth Care Authority pursuant to the same provisions and premiums\n\nas apply to the employees and retirees of other state agencies.\n\nEmployees and retirees may elect to keep their present agency\n\noffered life insurance, in addition to the state life insurance.\n\nAny employee who elects to keep their agency offered life insurance\n\nshall pay the premium for the life insurance provided pursuant to\n\nthe Oklahoma Employees Insurance and Benefits Act. Any Commission\n\nretiree who elects to participate in the life insurance program\n\nprovided pursuant to the Oklahoma Employees Insurance and Benefits\n\nAct shall pay the premium for such coverage.\nte life insurance.\n\nAny employee who elects to keep their agency offered life insurance\n\nshall pay the premium for the life insurance provided pursuant to\n\nthe Oklahoma Employees Insurance and Benefits Act. Any Commission\n\nretiree who elects to participate in the life insurance program\n\nprovided pursuant to the Oklahoma Employees Insurance and Benefits\n\nAct shall pay the premium for such coverage.\n\n(7) In the event that the agency offered life insurance plan is\n\ncanceled by the insurer offering it, the Commission shall contract\n\nwith the Authority for replacement coverage equal to that lost by\n\nsaid cancellation. The Authority is expressly authorized and\n\ndirected to enter into such a contract. The Commission and the\n\nparticipants shall pay the full actuarial costs and all reasonable\n\nadministrative costs for such coverage. Said actuarial and\n\nadministrative costs shall be divided between the Commission and the\n\nparticipants in the same ratio as premiums are now divided for the\n\nagency offered life insurance. The Authority shall maintain\n\nseparate reserves for said coverage. On January 1, 2005, the\n\nCommission shall convert the agency offered life insurance to the\n\nlife insurance plans provided by the Authority pursuant to the same\n\nprovisions and premiums as apply to the employees and retirees of\n\nother state agencies.
