The Oklahoma Health Care Authority shall have the authority\n\nto determine all rates and life, dental and health benefits. All\n\nrates shall be compiled in a comprehensive Schedule of Benefits.\n\nThe Schedule of Benefits shall be available for inspection during\n\nregular business hours at the Oklahoma Health Care Authority. The\n\nAuthority shall have the authority to annually adjust the rates and\n\nbenefits based on claim experience.\n\nB. The premiums for such insurance plans offered for the next\n\nplan year shall be established as follows:\n\n1. For active employees and their dependents, the Authority's\n\npremium determination shall be made no later than the bid submission\n\ndate for health maintenance organizations set by the Oklahoma\n\nEmployees Insurance and Benefits Board, which shall be set in August\n\nno later than the third Friday of that month; and\n\n2. For all other covered members and dependents, the\n\nAuthority's and the health maintenance organizations' premium\n\ndeterminations shall be no later than the fourth Friday of\n\nSeptember.\n\nC. The CEO of the Authority shall review for approval all rates\n\nand life, dental, and health benefits for the state sponsored plans\n\nrecommended by the Oklahoma Employees Insurance and Benefits Board.\n\nIf approved by the CEO of the Authority, those rates and benefits\n\nalong with the final health maintenance organizations’ rates and\n\nbenefits shall be sent to the Director of the Office of Management\n\nand Enterprise Services for final approval.\n\nD. The Office may approve a mid-year adjustment requested by\n\nthe Authority provided the need for an adjustment is substantiated\n\nby an actuarial determination or more current experience rating.\n\nThe only publication or notice requirements that shall apply to the\n\nSchedule of Benefits shall be those requirements provided in the\n\nOklahoma Open Meeting Act and within this section.
