The Oklahoma Employees Insurance and Benefits Board shall\n\nestablish a Disability Insurance Program for state employees. The\n\nprogram shall consist of a long-term disability plan and a short-\n\nterm disability plan. Participation in the program shall be limited\n\nto state employees who have been state employees for a period of not\n\nless than one (1) month and who are eligible for enrollment in the\n\nHealth Insurance Plan administered by the Board. No state employee\n\nshall be eligible to receive any benefits from the long-term\n\ndisability program unless the state employee has used all of the\n\nsick leave of the employee. The Board shall promulgate such rules\n\nas are necessary for adoption and administration of the Disability\n\nInsurance Program, including but not limited to benefit eligibility\n\nrequirements, methods for computing benefit amounts, benefits\n\namounts, and verification of medical and health status of employees\n\napplying for or receiving benefits.\n\nB. The Disability Insurance Program shall be funded from\n\nappropriations made by the Legislature. Employees shall not be\n\nrequired to make contributions to participate in the program.\n\nC. Employee disability insurance coverage shall begin on March\n\n1, 1986.\n\nD. The Board shall establish a grievance procedure by which a\n\nthree-member grievance panel established in the same manner as\n\nspecified in Section 1304.1 of this title shall act as an appeals\n\nbody for complaints regarding the allowance and payment of claims,\n\neligibility, and other matters. The grievance procedure provided by\n\nthis subsection shall be the exclusive remedy available to persons\n\nhaving complaints against the insurer. Such grievance procedure\n\nshall be subject to the Oklahoma Administrative Procedures Act,\n\nincluding provisions for the review of agency decisions by the\n\ndistrict court. The grievance panel shall schedule a hearing\n\nregarding the allowance and payment of claims, eligibility and other\n\nmatters within sixty (60) days from the date the grievance panel\n\nreceives a written request for a hearing. Upon written request to\n\nthe grievance panel received not less than ten (10) days before the\n\nhearing date, the grievance panel shall cause a full stenographic\n\nrecord of the proceedings to be made by a licensed or certified\n\ncourt reporter at the insured employee's expense.\n\nE.
