The Board shall establish a flexible benefits plan. All\n\nstate employers as defined in Section 1342 of this title shall offer\n\nthe flexible benefits plan to employees.\n\nB. Expenses included in an employee's salary adjustment\n\nagreement pursuant to the flexible benefits plan shall be limited to\n\nexpenses for:\n\n1. Dependent health insurance pursuant to the provisions of\n\nSection 1309 of this title;\n\n2. Insurance premiums or retirement plan premiums or payments\n\nwhich are supplemental to insurance or retirement programs offered\n\nby the State of Oklahoma or which are paid for under salary\n\nadjustment agreements pursuant to the provisions of paragraph 1, 3\n\nor 4 of subsection B of Section 7.10 of Title 62 of the Oklahoma\n\nStatutes;\n\n3. Dependent care;\n\n4. Medical care as defined by the Board; or\n\n5. All other eligible programs offered under Title 26, Section\n\n125 et seq. of the Internal Revenue Code of the United States.\n\nC. The amount by which an employee's salary is adjusted\n\npursuant to a salary adjustment agreement shall be excluded from\n\nincome in computation of income tax withholding, unemployment\n\npayments and workers' compensation coverage. Such amount shall be\n\nincluded as income in computation of state retirement contributions\n\nand benefits. Provided, if the inclusions and exclusions provided\n\nin this subsection conflict with the provisions of federal law or\n\nregulations pertaining to flexible benefits plans, the Board is\n\nauthorized to modify or abolish such inclusions and exclusions.\n\nD. The Administrator of the State and Education Employees Group\n\nInsurance Board with approval of the Board shall promulgate rules,\n\nregulations and procedures as necessary for implementation and\n\nadministration of the flexible benefits plan.\n\nE. The Administrator of the State and Education Employees Group\n\nInsurance Board under the direction of the Board shall contract with\n\none or more private firms or organizations to administer the\n\nflexible benefits plan. The contract shall be made at no cost to\n\nany employee of the State of Oklahoma.\n\nF. All employers shall begin offering the flexible benefits\n\nplan to employees not later than January 1, 1990.\n\nG. No less than thirty (30) working days prior to the annual\n\ndeadline for making changes to state employees’ benefit packages,\n\nall state agencies shall provide a one-day employee benefit\n\ninformational meeting. Representatives of vendors that have an\n\nauthorized payroll deduction for state employees pursuant to Section\n\n7.10 of Title 62 of the Oklahoma Statutes or Section 1701 of this\n\ntitle shall be invited and encouraged to attend these meetings to\n\nprovide benefit information and answer questions of state employees\n\nrelated to health, financial planning and other benefits. Agencies\n\nshall provide vendors with adequate space within which to meet with\n\nemployees. Agencies shall provide adequate notice of the meetings\n\nto active and retired employees, and shall allow each active\n\nemployee to spend at least sixty (60) minutes during the workday to\n\nattend the meetings.
