Stat. tit. 74, § 74-1363","heading":"Definitions","body":"The following words and phrases as used in Section 1361 et seq.\n\nof this title, unless a different meaning is clearly required by the\n\ncontext, shall have the following meanings:\n\n1. \"Authority\" means the Oklahoma Health Care Authority;\n\n2. \"Basic plan\" means the plan that provides the least amount\n\nof benefits each participant is required to purchase pursuant to the\n\nprovisions of the plan. The basic plan shall include only health,\n\ndental, disability and life benefits;\n\n3. \"Benefit\" means any of the benefits which may be purchased\n\nor is required to be purchased under the plan;\n\n4. \"Benefit plan\" means the specific terms and conditions\n\nregarding a benefit which may be purchased under the plan, including\n\nthe terms and conditions of any separate plan document, group\n\ninsurance policy or administrative services contract entered into by\n\nthe Oklahoma Employees Insurance and Benefits Board;\n\n5. \"Benefit price\" means the number of flexible benefit dollars\n\nneeded to purchase a benefit under the plan;\n\n6. \"Board\" means the Oklahoma Employees Insurance and Benefits\n\nBoard;\n\n7. \"Code\" means the Internal Revenue Code of 1986, as amended,\n\nfrom time to time;\n\n8. \"Compensation\" means the remuneration directly paid to a\n\nparticipating employee by a participating employer exclusive of\n\novertime pay, and longevity pay, calculated prior to and without\n\nregard to adjustments arising out of an employee's participation in\n\nthe plan authorized pursuant to this act, or amounts deferred under\n\nthe tax sheltered income deferment plans as authorized by Section\n\n1701 et seq. of this title;\n\n9. \"Default benefit\" means any benefit a participant who fails\n\nto make a proper election under the plan shall be deemed to have\n\npurchased;\n\n10. \"Dependent\" means a participant's spouse or any of his or\n\nher dependents as defined in Code Section 152 and regulations\n\npromulgated thereunder;\n\n11. \"Flexible benefit allowance\" means the annual amounts\n\ncredited by the participating employer for each participant for the\n\npurchase of benefits under the plan;\n\n12. \"Flexible benefit dollars\" means the sum of the flexible\n\nbenefit allowance and pay conversion dollars allocated by a\n\nparticipant pursuant to provisions of the plan;\n\n13. \"Participant\" means any officer or employee of a\n\nparticipating employer who is a member of the Oklahoma Law\n\nEnforcement Retirement System, the Oklahoma Public Employees\n\nRetirement System or the Uniform Retirement System for Justices and\n\nJudges, any officer or employee of a participating employer, whose\n\nemployment is not seasonal or temporary and whose employment\n\nrequires at least one thousand (1,000) hours of work per year and\n\nwhose salary and wage is equal to or greater than the hourly wage\n\nfor state employees, and any employee of a participating employer\n\nwho is a member of the Teachers' Retirement System of Oklahoma;\n\n14. \"Participating employer\" means any state agency, board,\n\ncommission, department, institution, authority, officer, bureau,\n\ncouncil, office or other entity created by the Oklahoma Constitution\n\nor statute that is a participating employer of the Oklahoma Law\n\nEnforcement Retirement System, the Oklahoma Public Employees\n\nRetirement System or the Uniform Retirement System for Justices and\n\nJudges, but shall not include any county, county hospital, city or\n\ntown, conservation district, any private or public trust in which a\n\ncounty, city or town participates and is the primary beneficiary,\n\nany school district or technology center school district, or\n\npolitical subdivision of the state, but shall include the State\n\nDepartment of Education, the Oklahoma Department of Wildlife\n\nConservation, the Oklahoma Employment Security Commission, the\n\nTeachers' Retirement System of Oklahoma and the Oklahoma Department\n\nof Career and Technology Education. Provided the term\n\n\"participating employer\" shall also mean the State Regents for\nr school district, or\n\npolitical subdivision of the state, but shall include the State\n\nDepartment of Education, the Oklahoma Department of Wildlife\n\nConservation, the Oklahoma Employment Security Commission, the\n\nTeachers' Retirement System of Oklahoma and the Oklahoma Department\n\nof Career and Technology Education. Provided the term\n\n\"participating employer\" shall also mean the State Regents for\n\nHigher Education or any institution under the authority of the State\n\nRegents for Higher Education upon agreement between the State\n\nRegents for Higher Education or the appropriate governing board of\n\nan institution under the authority of the State Regents for Higher\n\nEducation and the Board;\n\n15. \"Pay conversion dollars\" means amounts by which a\n\nparticipant elects to reduce the participant’s compensation to\n\npurchase benefits under the plan;\n\n16. \"Plan\" means the flexible benefits plan authorized pursuant\n\nto the State Employees Flexible Benefits Act as modified by the\n\nprovisions of this act;\n\n17. \"Plan year\" means for the plan year beginning July 1, 2001,\n\nthe six-month period commencing on July 1 and ending on the\n\nfollowing December 31. The next plan year shall begin January 1,\n\n2002. It shall mean the twelve-month period commencing on January 1\n\nand ending on the following December 31;\n\n18. \"Salary adjustment agreement\" means a written agreement\n\nbetween a participant and participating employer whereby the\n\nemployer agrees to adjust the salary of the participant by a stated\n\namount or an amount equal to the cost of benefits selected under the\n\nplan and the participating employer agrees to contribute such amount\n\nto cover certain costs of the benefits selected by the participant\n\nto the Board; and\n\n19. \"Termination\" means the termination of a participant's\n\nemployment as an employee of a participating employer, whether by\n\nreasons of discharge, voluntary termination, retirement, death or\n\nreduction-in-force.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"aa4ef90528c4cc0dfc2ee1e7627560e366e37693c8e6c036f029abd1d34b21a4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-1362","next":"us-ok/okla.-stat.-tit.-74-74-1366"},"notice":"GroundRules: Original legal text.
