Stat. tit. 74, § 74-1366","heading":"Flexible benefits plan - Awarding of contracts -","body":"Employee's salary adjustment agreement.\n\nA. The Office of Management and Enterprise Services shall\n\nestablish a flexible benefits plan in accordance with the provisions\n\nof Section 1361 et seq. of this title. All participating employers\n\nshall offer the plan to their eligible employees.\n\nB. The Office shall interpret the plan and decide any matters\n\narising thereunder and may adopt such rules and procedures as it\n\ndeems necessary, desirable or appropriate in the administration of\n\nthe plan subject to the Administrative Procedures Act. All rules\n\nand decisions of the Office shall be uniformly and consistently\n\napplied to all participants in similar circumstances and shall be\n\nconclusive and binding on all persons having an interest in the\n\nplan. When making any decision or determination, the Office shall\n\nbe entitled to rely upon such information as may be furnished to it\n\nby a participant, a participating employer, legal counsel, third\n\nparty administrator or the management of any individual benefit plan\n\nwhich is incorporated in the plan.\n\nC. The Office may contract with one or more firms or\n\norganizations to administer or provide consulting services in regard\n\nto all or any portion of the plan.\n\nThe Office shall solicit proposals on a competitive bid basis.\n\nContracts for the flexible benefits plan shall not be subject to the\n\nprovisions of The Oklahoma Central Purchasing Act, Section 85.1 et\n\nseq. of this title. The Office shall promulgate rules establishing\n\nappropriate competitive bidding criteria and procedures for\n\ncontracts awarded for flexible benefits plans.\n\nWhen awarding a contract for services pursuant to this\n\nsubsection, the Office shall satisfy itself that the contractor has\n\nno interests which would impair its ability to perform the tasks and\n\nservices required and that the contractor will exercise proper\n\nindependent judgment when performing its responsibilities under\n\nSection 1361 et seq. of this title and under the contract.\n\nD. Expenses included in an employee's salary adjustment\n\nagreement pursuant to the flexible benefits plan shall be limited to\n\nexpenses for:\n\n1. Premiums for any health insurance, health maintenance\n\norganization, life insurance, long term disability insurance, dental\n\ninsurance or high deductible health benefit plan offered to\n\nemployees and their dependents;\n\n2. Insurance premiums or retirement plan premiums or payments\n\nwhich are supplemental to insurance or retirement programs offered\n\nby this state or which are paid for under salary adjustment\n\nagreements pursuant to the provisions of Section 34.70 of Title 62\n\nof the Oklahoma Statutes;\n\n3. Dependent care;\n\n4. Medical care, as defined by the Office; and\n\n5. All other eligible benefit programs offered under 26 United\n\nStates Code Section 125.\n\nE. The amount by which an employee's salary is adjusted\n\npursuant to a salary adjustment agreement shall be excluded from\n\nincome in computation of income tax withholding, federal insurance\n\ncontributions act taxes, unemployment payments and workers'\n\ncompensation coverage. Such amount shall be included as income in\n\ncomputation of state retirement contributions and benefits.\n\nProvided, if the inclusions and exclusions provided in this\n\nsubsection conflict with the provisions of federal law or\n\nregulations pertaining to flexible benefits plans, the Council is\n\nauthorized to modify or abolish such inclusions and exclusions.\n\nF. 1. Legal representation shall be provided by the Office of\n\nthe Attorney General.\n\n2. The executive director shall be the appointing authority and\n\nagency head.
