Stat. tit. 74, § 74-1372","heading":"Claims for flexible spending account benefits - Notice of","body":"denial - Hearing.\n\nThe Office of Management and Enterprise Services shall be\n\nresponsible for making all determinations as to the rights of any\n\nparticipant or any beneficiary of a participant to receive amounts\n\nunder the flexible spending account benefits plan. The Office shall\n\nprescribe forms and procedures for making claims for flexible\n\nspending account benefits under the plan. Each person making a\n\nclaim for benefits under the flexible spending account benefits plan\n\nshall also furnish the Office with such documents, evidence, data or\n\ninformation in support of such claim as the Oklahoma Employees\n\nInsurance and Benefits Board considers necessary or desirable. If\n\nany claim for the flexible spending account benefits plan is wholly\n\nor partially denied, the claimant shall be given notice in writing\n\nof such denial within a reasonable period of time, but no later than\n\nforty-five (45) days after the claim is filed.\n\nA claimant whose claim is denied shall have the right to a\n\nhearing before the Director of the Office of Management and\n\nEnterprise Services or hearing officer designated by the Director.\n\nWritten notification by a claimant for a hearing must be received by\n\nthe executive director within ten (10) business days of notification\n\nof claim denial. The hearing shall be conducted within thirty (30)\n\ndays in accordance with the provisions of the Administrative\n\nProcedures Act.
