All property which comes into the possession of the Oklahoma\n\nState Bureau of Investigation (OSBI), whether the same is stolen,\n\nembezzled or otherwise, which the Bureau has held for at least one\n\n(1) year unless said property is perishable, may be disposed of by\n\norder of an Oklahoma County district court if the owner or owners of\n\nsaid property are unknown or have not claimed the same. The\n\nDirector of the Oklahoma State Bureau of Investigation shall then be\n\nauthorized to sell, deposit, or otherwise dispose of such property\n\nor any part thereof which is no longer needed to be held as evidence\n\nor otherwise used in connection with any litigation.\n\nB. 1. If cash or other legal tender is the subject of the\n\naction, the Director shall file a petition in the district court of\n\nOklahoma County requesting authority to forfeit and deposit the\n\nfunds. The petition shall include the following information:\n\na. description of the property,\n\nb. approximate date that the property came into\n\npossession of the Director, and\n\nc. the names of the owner or owners, if known.\n\n2. Upon the filing of the petition, notice of at least ten (10)\n\ndays shall be given to each known owner by the Director of the OSBI\n\nby mailing a copy of the petition and notice of hearing to the\n\nlast-known address of each owner.\n\n3. Notice of the hearing shall also be posted at the Oklahoma\n\nCounty courthouse at the regular place assigned for the posting of\n\nlegal notices and in the public lobby at OSBI headquarters.\n\n4. If no owner appears and establishes ownership to the cash or\n\nlegal tender, the court shall enter an order authorizing the\n\nforfeiture of the funds to the OSBI. All monies forfeited shall be\n\ndeposited into the OSBI Revolving Fund.\n\nC. 1. For disposition of all other seized property, the\n\nDirector shall file a petition in the district court of Oklahoma\n\nCounty requesting authority to conduct a sale of the property. The\n\npetition shall include the following information:\n\na. description of the property,\n\nb. approximate date that the property came into the\n\npossession of the Director, and\n\nc. the names of the owner or owners, if known.\n\n2. Upon the filing of the petition, notice of at least ten (10)\n\ndays shall be given to each known owner by the Director of the OSBI\n\nby mailing a copy of the petition and notice of hearing to the\n\nlast-known address of each owner.\n\n3. Notice of the hearing shall also be posted at the Oklahoma\n\nCounty courthouse at the regular place assigned for the posting of\n\nlegal notices and in the public lobby at OSBI headquarters.\n\n4. If no owner appears and establishes ownership to the\n\nproperty, the court shall enter an order authorizing the Director to\n\nsell the property to the highest bidder after notice of at least\n\nfive (5) days of the auction has been given by publication in one\n\nissue of a legal newspaper of record in Oklahoma County.\n\n5. The Director shall make a return of sale, and when confirmed\n\nby the court, the order confirming the sale shall vest title of the\n\nproperty to the purchaser.
