Stat. tit. 74, § 74-150.28a","heading":"Statewide electronic tracking system for sexual","body":"assault evidence collection kits.\n\nA. The Criminalistics Services Division of the Oklahoma State\n\nBureau of Investigation (OSBI) shall develop and implement a\n\nstatewide electronic tracking system for evidence collection kits\n\nused to collect and preserve evidence of a sexual assault or other\n\nsex offense. All sexual assault evidence collection kits, purchased\n\nand/or distributed by the Oklahoma State Bureau of Investigation to\n\ncollection sites on or after October 1, 2019, shall be trackable and\n\nshall comply with the requirements of the electronic tracking\n\nsystem.\n\nB. The Division Director of the OSBI Crime Laboratory shall\n\nimplement protocols and administer the tracking system. The\n\nDivision Director shall implement protocols and the Bureau shall\n\npromulgate rules and guidelines to ensure that previously untested\n\nsexual assault evidence collection kits are trackable and are\n\nentered into the tracking system. Any law enforcement agency,\n\nmedical provider or forensic laboratory that has in its custody a\n\npreviously untested sexual assault evidence collection kit used for\n\na forensic medical examination shall comply with the established\n\nprotocols, rules and guidelines relating to all untested kits.\n\nC. For purposes of this section, \"previously untested sexual\n\nassault evidence collection kit\" means any kit that has not\n\nundergone forensic testing and was identified and included in the\n\n2017-2018 statewide inventories of kits in law enforcement custody\n\npursuant to the Governor's Executive Order 2017-11. To the extent\n\npracticable, and consistent with protecting victim confidentiality\n\nfor unreported sexual assaults, a law enforcement agency having\n\ncustody of a kit governed by this subsection shall take reasonable\n\nmeasures to provide appropriate tracking information to the affected\n\nvictim.\n\nD. The tracking system shall:\n\n1. Track the location and status of each evidence collection\n\nkit through the criminal justice process, including the initial\n\ncollection of evidence for the kit in a forensic medical examination\n\nperformed at a health care facility, receipt and storage of the kit\n\nat a law enforcement agency, receipt and analysis of the kit at an\n\naccredited crime laboratory, and storage and destruction of the kit\n\nafter the applicable evidence is analyzed;\n\n2. Allow a health care facility performing a forensic medical\n\nexamination of a survivor, law enforcement agency, accredited crime\n\nlaboratory, prosecutor or other entity providing a chain of custody\n\nfor an evidence collection kit to update and track the status and\n\nlocation of the kits; and\n\n3. Allow a survivor to anonymously track or receive updates\n\nregarding the statute and location of the survivor's evidence\n\ncollection kit.\n\nE. The Bureau shall require participation in the tracking\n\nsystem by all medical providers, law enforcement agencies, forensic\n\nlaboratories or other persons or entities having custody or use of\n\nany sexual assault evidence collection kit in the State of Oklahoma.\n\nThese entities shall participate in the tracking system and comply\n\nwith the established protocols, rules and guidelines. A\n\nparticipating entity shall be permitted to access the entity's\n\ntracking information through the System.\n\nF. Records entered into the tracking system are confidential.\n\nRecords relating to an evidence collection kit may be accessed only\n\nby:\n\n1. The survivor for whom the evidence collection kit was\n\ncompleted; or\n\n2. An employee of an entity described by subsection C for\n\npurposes of updating or tracking the status or location of the\n\nevidence collection kit.\n\nG.
