In addition to guidelines and procedures for the collection,\n\nsubmission and testing of DNA evidence that is obtained in\n\nconnection with an alleged sexual assault, the Oklahoma State Bureau\n\nof Investigation (OSBI) and each accredited crime laboratory within\n\nthe State of Oklahoma in partnership with the Oklahoma Sexual\n\nAssault Forensic Evidence Task Force shall implement a priority\n\nprotocol for the testing of untested sexual assault evidence kits,\n\nwhich shall include, but not be limited to:\n\n1. A process to identify the kits that were never examined and\n\nthose that were partially examined for probability of obtaining\n\nCombined DNA Index System (CODIS) eligible DNA profiles;\n\n2. Whether the statute of limitations has passed for the\n\nalleged crime;\n\n3. Whether the offender is a stranger or non-stranger to the\n\nvictim; and\n\n4. A process to identify those kits where the victim was or is\n\nparticipating in the criminal justice process and has consented to\n\nthe testing of the kit.\n\nB. Untested kits that have been identified as part of the\n\ncurrent backlog of untested or kits not submitted shall not be\n\ntested where:\n\n1. The victim has not reported to law enforcement;\n\n2. The victim has requested that the kit not be tested; or\n\n3. The offender has been convicted for the crime and his or her\n\nprofile is in the Combined DNA Index System (CODIS).\n\nC.
