For purposes of this act:\n\n1. “ABFT” shall mean the American Board of Forensic Toxicology,\n\nan accrediting body for toxicology;\n\n2. “Accredited” shall mean recognized formally by an\n\naccrediting body as meeting or exceeding applicable quality\n\nstandards;\n\n3. “Accrediting body” shall mean a nationally recognized\n\norganization that has developed and maintained an independent\n\nsystem, based upon ISO/IEC 17025 standards, for providing\n\nlaboratories with an impartial review of laboratory operations and\n\nthat provides formal recognition or certification to laboratories\n\nwho demonstrate continued compliance with those standards and other\n\nsupplemental forensic standards which are specific to the\n\nmaintenance and testing of forensic evidence;\n\n4. “ISO/IEC 17025” shall mean the International Organization of\n\nStandards/International Electrotechnical Commission standard 17025\n\nthat is published by the International Organization for\n\nStandardization and the International Electrotechnical Commission\n\nand included as a standard in general requirements for the\n\ncompetence of testing and calibration laboratories;\n\n5. “Forensic laboratory” shall mean a laboratory operated by\n\nthe state or any unit of municipal, county, city or other local\n\ngovernment that examines physical evidence in criminal matters and\n\nprovides opinion testimony in a court of law;\n\n6. “Toxicology analysis” shall mean a laboratory analysis\n\nwhereby biological samples are tested for alcohol and/or other toxic\n\nor intoxicating substances;\n\n7. “IAI” shall mean the International Association for\n\nIdentification; and\n\n8. “Supplemental forensic standards” shall mean additional\n\nrequirements specifically related to maintenance and analysis of\n\nforensic evidence required in addition to the calibration and\n\ntesting requirements of ISO/IEC 17025 standards.\n\nB. Effective July 1, 2005, all forensic laboratories as defined\n\nin this act established or operating prior to that date shall be\n\naccredited. The following exceptions shall apply:\n\n1. Breath testing for alcohol;\n\n2. Field testing, crime scene processing, crime scene evidence\n\ncollection, searches, examinations or enhancements of digital\n\nevidence, and crime scene reconstruction;\n\n3. Latent print identification performed by an IAI certified\n\nlatent print examiner;\n\n4. Marihuana identification using methods generally accepted in\n\nthe forensic field that are approved by a forensic laboratory\n\naccredited in controlled substances;\n\n5. All forensic laboratories established on or after July 1,\n\n2005, as defined in this act, shall be accredited within two (2)\n\nyears of establishment; and\n\n6. Forensic laboratories that exclusively and solely perform\n\nforensic toxicology analysis may meet this requirement by being\n\neither accredited through an accrediting body as defined in this\n\nsection or accredited by ABFT.\n\nC. On or after July 1, 2005, testimony, results, reports, or\n\nevidence of forensics analysis produced on behalf of the prosecution\n\nin a criminal trial shall be done by an accredited forensic\n\nlaboratory. This section shall not apply to:\n\n1. Testimony, results, reports, or evidence of forensic\n\nanalysis produced by a forensic laboratory established after July 1,\n\n2005, and not yet required to be accredited as set forth in\n\nsubsection B of this section;\n\n2. Testimony, results, reports, or evidence of forensic\n\nanalysis produced by a forensic laboratory prior to July 1, 2005.\n\nSuch testimony, results, reports, or evidence need not be performed\n\nby an accredited forensic laboratory and may be produced or\n\npresented on behalf of the prosecution in a criminal trial after\n\nJuly 1, 2005, as long as the forensic analysis was produced prior to\n\nthat date;\n\n3. Testimony, results, reports, or evidence of breath testing\n\nfor alcohol;\n\n4. Testimony, results, reports, or evidence of field testing,\nn accredited forensic laboratory and may be produced or\n\npresented on behalf of the prosecution in a criminal trial after\n\nJuly 1, 2005, as long as the forensic analysis was produced prior to\n\nthat date;\n\n3. Testimony, results, reports, or evidence of breath testing\n\nfor alcohol;\n\n4. Testimony, results, reports, or evidence of field testing,\n\ncrime scene processing, crime scene evidence collection, searches,\n\nexaminations or enhancements of digital evidence, and crime scene\n\nreconstruction;\n\n5. Testimony, results, reports, or evidence of latent print\n\nidentification performed by an IAI certified latent print examiner;\n\nand\n\n6.
