In any investigation relating to investigations performed by\n\nthe Oklahoma State Bureau of Investigation (OSBI) related to\n\nInternet Crimes Against Children (ICAC), child abuse or child\n\nexploitation, violations of the Oklahoma Computer Crimes Act,\n\nthreats against public officials, suspicious deaths, or violent\n\ncrimes, the Director of the OSBI, if recommended and approved by an\n\nagent with the rank of Captain or above and the General Counsel or\n\nAssistant General Counsel of the Bureau, may subpoena witnesses,\n\ncompel the attendance and testimony of witnesses, and require the\n\nproduction of any records, including books, papers, documents, and\n\nother tangible things which constitute or contain evidence, which\n\nthe Director or agent finds relevant or material to the\n\ninvestigation. The attendance of witnesses and the production of\n\nrecords may be required from any place in the state to a designated\n\nlocation in the county seat of the county of which the subpoenaed\n\nperson is an inhabitant or in which the subpoenaed person carries on\n\nbusiness or may be found. Witnesses summoned pursuant to this\n\nsection shall be paid the same fees and mileage that are paid\n\nwitnesses in the courts of this state.\n\nB. The witness shall have the option of complying with the\n\nsubpoena by:\n\n1. Appearing and/or producing documents, as requested; or\n\n2. Notifying the Bureau, in writing, of refusal to appear or\n\nproduce documents within ten (10) days of the date of service.\n\nThe subpoena form shall clearly set forth the optional means of\n\ncompliance including instructions for sending written notice of\n\nrefusal.\n\nC. A subpoena issued pursuant to this section may be served by\n\nany person designated in the subpoena to serve it. Service upon a\n\nnatural person may be made by personal delivery of the subpoena to\n\nhim or her. Service may be made upon a domestic or foreign\n\ncorporation or upon a partnership or other unincorporated\n\nassociation which is subject to suit under a common name, by\n\ndelivering the subpoena to an officer, to a managing or general\n\nagent, or to any other agent authorized by appointment or by law to\n\nreceive service of process. The affidavit of the person serving the\n\nsubpoena entered on a true copy thereof by the person serving it\n\nshall be proof of service.\n\nD. In the case of contumacy by or refusal to obey a subpoena\n\nissued to any person, the Director may invoke the aid of any\n\ndistrict court of the state within the jurisdiction of which the\n\ninvestigation is carried on or of which the subpoenaed person is an\n\ninhabitant, or in which he or she carries on business or may be\n\nfound, to compel compliance with the subpoena. The court may issue\n\nan order requiring the subpoenaed person to appear before the\n\nDirector to produce records, if so ordered, or to give testimony\n\ntouching the matter under investigation. Any failure to obey the\n\norder of the court may be punished by the court as an indirect\n\ncontempt thereof. All process in any such case may be served in any\n\njudicial district in which such person may be found.\n\nE.
