Stat. tit. 74, § 74-151.3","heading":"Unidentified persons – Missing persons – Data","body":"procedures.\n\nA. As used in this section:\n\n1. \"Missing person\" means any person, including a child under\n\neighteen (18) years of age, reported to Oklahoma law enforcement as\n\nmissing and unaccounted for from expected and normal activities; and\n\n2. \"Unidentified person\" means any person living or deceased\n\nwho is unidentified after all available methods have been exhausted.\n\nThis includes any decedent released to the Office of the Chief\n\nMedical Examiner (OCME) where the identity of the decedent cannot be\n\nestablished to the satisfaction of the Chief Medical Examiner.\n\nB. Unidentified Persons. The OCME and the Oklahoma State\n\nBureau of Investigation (OSBI) shall input the following data, if\n\navailable for unidentified persons, into the National Missing and\n\nUnidentified Persons System (NamUs), created by the National\n\nInstitute of Justice of the United States Department of Justice:\n\n1. Copies of fingerprints on standardized eight inch by eight\n\ninch (8\" x 8\") fingerprint cards or the equivalent digital image;\n\nprints or partial prints of any fingers;\n\n2. Any forensic dental report or radiology imaging;\n\n3. Detailed personal descriptions;\n\n4. Deoxyribonucleic acid (DNA) information;\n\n5. Radiology imaging and medical data; and\n\n6. All other identifying data, including date and place of\n\ndeath.\n\nC. Missing Persons. Once a missing persons report is received,\n\nthe law enforcement agency shall initiate the following procedures\n\nwithin thirty (30) days of receiving the report:\n\n1. Submit the missing persons case to NamUs and to any database\n\nof missing persons currently required by the agency, providing all\n\nappropriate data;\n\n2. Locate and obtain biometric records, including medical and\n\ndental records, medical and dental X-rays or other medical imaging,\n\nand enter the records into NamUs. All medical and dental records\n\nobtained shall be considered confidential and shall not be released\n\nto the public;\n\n3. Utilize NamUs family reference sample (FRS) submission kits,\n\nobtain voluntary DNA samples from appropriate family members to\n\nsubmit to an institution of higher education that specializes in DNA\n\nidentification for a full genetic profile, including testing of\n\nmitochondrial DNA (mtDNA), short tandem repeats on the Y-chromosome\n\n(Y-STR) and nuclear analyses, to be documented in the NamUs missing\n\npersons file and submitted to the FBI's National DNA Index System\n\n(NDIS) using the Combined DNA Index System (CODIS). If necessary,\n\nthe law enforcement agency may request assistance in obtaining FRS\n\nDNA samples; and\n\n4. Attempt to locate any fingerprints from available resources\n\nand submit those records to NamUs.\n\nD. Upon request by local law enforcement, the OSBI shall\n\nattempt to locate any fingerprints and photographs from the\n\navailable resources and submit those records to NamUs.\n\nE. No Oklahoma law enforcement agency shall require a delay in\n\nthe taking of a report of a missing person when reliable information\n\nhas been provided to the law enforcement agency that the person is\n\nmissing. No law enforcement agency shall mandate the appearance of\n\na next of kin before initiating a missing persons investigation.\n\nF. If the OSBI receives a report of a missing person from\n\nanother law enforcement agency or medical examiner, the OSBI shall\n\nmaintain a record of the case file. The OSBI shall promulgate rules\n\nrelating to the dissemination and retention of the records. The\n\nrules shall require that the process of releasing the records shall\n\noccur as soon as practicable from the time the OSBI receives a\n\nreport that a person, for whom there is a previous record, is\n\nmissing.\n\nG. The information contained in the missing persons files of\n\nthe OSBI shall be available to the OCME and law enforcement agencies\n\nattempting to identify unidentified persons.\n\nH. No law enforcement agency shall establish or maintain any\n\npolicy which requires the observance of a waiting period before\nme the OSBI receives a\n\nreport that a person, for whom there is a previous record, is\n\nmissing.\n\nG. The information contained in the missing persons files of\n\nthe OSBI shall be available to the OCME and law enforcement agencies\n\nattempting to identify unidentified persons.\n\nH. No law enforcement agency shall establish or maintain any\n\npolicy which requires the observance of a waiting period before\n\naccepting and investigating a missing child report. Upon receipt of\n\na report of a missing child, a law enforcement agency shall enter\n\nthe child into the National Crime Information Center (NCIC) pursuant\n\nto a mandate by the Federal Bureau of Investigation which requires\n\nthe name of the missing child to be entered within two (2) hours\n\nfrom the time the child is reported missing to the law enforcement\n\nagency.\n\nI. When a person previously reported missing has been found or\n\nwhen an unidentified person has been identified, the reporting\n\nagency or OCME shall report to NamUs within twenty-four (24) hours\n\nthat the person has been found and that the case can be archived\n\nwithin NamUs.\n\nJ. Nothing in this section prohibits a law enforcement agency\n\nor the OCME from maintaining case files related to missing persons\n\nor unidentified bodies.\n\nK. Nothing in this section supersedes the authority of the OCME\n\nto obtain dental or medical records, including X-rays, in cases in\n\nwhich these records are necessary for the identification of human\n\nremains.\n\nL. The Council on Law Enforcement Education and Training\n\n(CLEET) shall establish appropriate training resources focused on\n\nthe investigations of unidentified and missing persons and shall\n\nrequire all CLEET-certified law enforcement officers to complete\n\nsuch training on a regular basis to be determined by CLEET.
