Stat. tit. 74, § 74-166.5","heading":"Commission for Rehabilitation Services - Powers and","body":"duties - Trust for the School for the Blind and School for the Deaf.\n\nA. The Commission for Rehabilitation Services shall have the\n\npowers and duties to:\n\n1. Adopt bylaws and promulgate rules for the regulation of its\n\naffairs and the conduct of its business;\n\n2. Formulate policies and adopt rules for the effective\n\nadministration of the duties of the State Department of\n\nRehabilitation Services;\n\n3. Adopt an official seal;\n\n4. Establish an office;\n\n5. Sue and to be sued, subject to the provisions of The\n\nGovernmental Tort Claims Act;\n\n6. Make and enter into all contracts necessary or incidental to\n\nthe performance of its duties and the execution of its powers;\n\n7. Purchase or lease equipment, furniture, materials and\n\nsupplies, and incur such other expenses as may be necessary to\n\nmaintain and operate the Commission and the State Department of\n\nRehabilitation Services, or to discharge its duties and\n\nresponsibilities or to make any of its powers effective;\n\n8. Acquire by purchase, lease, gift, solicitation of gift or by\n\nany other manner, and to maintain, use and operate or to contract\n\nfor the maintenance, use and operation of or lease of any and all\n\nproperty of any kind, real, personal or mixed or any interest\n\ntherein unless otherwise provided by Section 166.1 et seq. of this\n\ntitle; provided that, all contracts for real property shall be\n\nsubject to the provisions of Section 63 of this title;\n\n9. Appoint such officers, agents and employees as it deems\n\nnecessary to operate and maintain the Commission and to prescribe\n\ntheir duties and to fix their compensation;\n\n10. Perform such other acts as shall be necessary for the\n\naccomplishment of the purposes of Section 166.1 et seq. of this\n\ntitle; and\n\n11. Serve as trustee for the trust created in subsection B of\n\nthis section for the benefit of the Oklahoma School for the Blind\n\nand the Oklahoma School for the Deaf.\n\nB. 1. The Commission for Rehabilitation Services is hereby\n\nauthorized and directed to create a trust into which all real\n\nproperty held by the Commission for the benefit of the Oklahoma\n\nSchool for the Blind and the Oklahoma School for the Deaf shall be\n\ntransferred.\n\n2. The property placed in trust:\n\na. shall be held for the sole benefit of the Oklahoma\n\nSchool for the Blind and the Oklahoma School for the\n\nDeaf,\n\nb. if not needed for use by the schools, may be leased or\n\nrented to others and all income received from such\n\nleases or rentals shall be payable to the Commission\n\nand deposited in the Rehabilitation Services\n\nDisbursing Fund for use by the Commission to fulfill\n\nthe purposes of the Oklahoma School for the Blind and\n\nthe Oklahoma School for the Deaf, and\n\nc. may be sold if the commissioners, acting as trustees,\n\ndetermine that the sale is in the best interest of the\n\nOklahoma School for the Blind or the Oklahoma School\n\nfor the Deaf. The proceeds from the sale of the\n\nproperty shall be held in the trust corpus and shall\n\nbe invested by the State Treasurer. Income derived\n\nfrom the corpus shall be used by the Commission for\n\nthe purposes of the Oklahoma School for the Blind and\n\nthe Oklahoma School for the Deaf.\n\n3. The corpus of the trust may be disbursed only upon\n\nlegislative approval.\n\n4. The trust may be dissolved only upon legislative approval.\n\nC. Upon the creation of the trust authorized in subsection B of\n\nthis section, the Office of Management and Enterprise Services shall\n\nprovide all necessary assistance to the Department of Rehabilitation\n\nServices to identify and transfer all real property held by or for\n\nthe benefit of the Oklahoma School for the Blind and the Oklahoma\n\nSchool for the Deaf to the trust.\n\nD. 1. The Commission for Rehabilitation Services may accept\n\nand receive any and all gifts, donations, devices, bequests, grants\n\nor contracts of any kind for money or property, either real or\nto the Department of Rehabilitation\n\nServices to identify and transfer all real property held by or for\n\nthe benefit of the Oklahoma School for the Blind and the Oklahoma\n\nSchool for the Deaf to the trust.\n\nD. 1. The Commission for Rehabilitation Services may accept\n\nand receive any and all gifts, donations, devices, bequests, grants\n\nor contracts of any kind for money or property, either real or\n\npersonal, for the benefit of the Oklahoma School for the Blind and\n\nthe Oklahoma School for the Deaf.\n\n2. The Commission is directed, authorized and empowered to hold\n\nsuch funds or property outright or in trust, invest or sell the\n\nproperty and use the principal or interest or proceeds of sale for\n\nthe benefit of the Oklahoma School for the Blind and the Oklahoma\n\nSchool for the Deaf.\n\n3. The Commission shall utilize its best efforts to comply with\n\nthe terms of any conditional gift, devise or bequest in fulfillment\n\nof the donor's stipulations and provisions of applicable laws. Any\n\nreal or personal property donated with conditions which are at any\n\ntime determined to be infeasible to meet or continue may be returned\n\nto the donor, or if the donor is no longer living, if a natural\n\nperson, or no longer a legally organized entity, for organizations,\n\nthen the property may be sold and the proceeds of the sale deposited\n\nin the Commission's general fund or the property may be further\n\ndonated in kind.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0fc2539348bacfbc18158b5abe39eceb9c7dd0a76fe350949059c144c0d5fe41","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-166.4","next":"us-ok/okla.-stat.-tit.-74-74-166.7"},"notice":"GroundRules: Original legal text.
