Stat. tit. 74, § 74-18b","heading":"Duties of Attorney General - Counsel of Corporation","body":"Commission as representative on appeal from Commission.\n\nA. The duties of the Attorney General as the chief law officer\n\nof the state shall be:\n\n1. To appear for the state and prosecute and defend all actions\n\nand proceedings, civil or criminal, in the Supreme Court and Court\n\nof Criminal Appeals in which the state is interested as a party;\n\n2. To appear for the state and prosecute and defend all actions\n\nand proceedings in any of the federal courts in which the state is\n\ninterested as a party;\n\n3. To initiate or appear in any action in which the interests\n\nof the state or the people of the state are at issue, or to appear\n\nat the request of the Governor, the Legislature, or either branch\n\nthereof, and prosecute and defend in any court or before any\n\ncommission, board or officers any cause or proceeding, civil or\n\ncriminal, in which the state may be a party or interested; and when\n\nso appearing in any such cause or proceeding, the Attorney General\n\nmay, if the Attorney General deems it advisable and to the best\n\ninterest of the state, take and assume control of the prosecution or\n\ndefense of the state's interest therein;\n\n4. To consult with and advise district attorneys, when\n\nrequested by them, in all matters pertaining to the duties of their\n\noffices, when the district attorneys shall furnish the Attorney\n\nGeneral with a written opinion supported by citation of authorities\n\nupon the matter submitted;\n\n5. To give an opinion in writing upon all questions of law\n\nsubmitted to the Attorney General by the Legislature or either\n\nbranch thereof, or by any state officer, board, commission or\n\ndepartment, provided, that the Attorney General shall not furnish\n\nopinions to any but district attorneys, the Legislature or either\n\nbranch thereof, or any other state official, board, commission or\n\ndepartment, and to them only upon matters in which they are\n\nofficially interested;\n\n6. At the request of the Governor, State Auditor and Inspector,\n\nState Treasurer, or either branch of the Legislature, to prosecute\n\nany official bond or any contract in which the state is interested,\n\nupon a breach thereof, and to prosecute or defend for the state all\n\nactions, civil or criminal, relating to any matter connected with\n\neither of their Departments;\n\n7. Whenever requested by any state officer, board or\n\ncommission, to prepare proper drafts for contracts, forms and other\n\nwriting which may be wanted for the use of the state;\n\n8. To prepare drafts of bills and resolutions for individual\n\nmembers of the Legislature upon their written request stating the\n\ngist of the bill or resolution desired;\n\n9. To enforce the proper application of monies appropriated by\n\nthe Legislature and to prosecute breaches of trust in the\n\nadministration of such funds;\n\n10. To institute actions to recover state monies illegally\n\nexpended, to recover state property and to prevent the illegal use\n\nof any state property, upon the request of the Governor or the\n\nLegislature;\n\n11. To pay into the State Treasury, immediately upon its\n\nreceipt, all monies received by the Attorney General belonging to\n\nthe state;\n\n12. To settle, compromise and dispose of an action in which the\n\nAttorney General represents the interests of the state, so long as\n\nthe consideration negotiated for such settlement, compromise or\n\ndisposition is payable to the state or one of its agencies which is\n\na named party of the action and any monies, any property or other\n\nitem of value is paid first to the State Treasury;\n\n13. To keep and file copies of all opinions, contracts, forms\n\nand letters of the office, and to keep an index of all opinions,\n\ncontracts and forms according to subject and section of the law\n\nconstrued or applied;\n\n14. To keep a register or docket of all actions, demands and\n\ninvestigations prosecuted, defended or conducted by the Attorney\n\nGeneral in behalf of the state. The register or docket shall give\np and file copies of all opinions, contracts, forms\n\nand letters of the office, and to keep an index of all opinions,\n\ncontracts and forms according to subject and section of the law\n\nconstrued or applied;\n\n14. To keep a register or docket of all actions, demands and\n\ninvestigations prosecuted, defended or conducted by the Attorney\n\nGeneral in behalf of the state. The register or docket shall give\n\nthe style of the case or investigation, where pending, court number,\n\noffice number, the gist of the matter, result and the names of the\n\nassistants who handled the matter;\n\n15. To keep a complete office file of all cases and\n\ninvestigations handled by the Attorney General on behalf of the\n\nstate;\n\n16. To report to the Legislature or either branch thereof\n\nwhenever requested upon any business relating to the duties of the\n\nAttorney General's office;\n\n17. To institute civil actions against members of any state\n\nboard or commission for failure of such members to perform their\n\nduties as prescribed by the statutes and the Constitution and to\n\nprosecute members of any state board or commission for violation of\n\nthe criminal laws of this state where such violations have occurred\n\nin connection with the performance of such members' official duties;\n\n18. To respond to any request for an opinion of the Attorney\n\nGeneral's office, submitted by a member of the Legislature,\n\nregardless of subject matter, by written opinion determinative of\n\nthe law regarding such subject matter;\n\n19. To convene multicounty grand juries in such manner and for\n\nsuch purposes as provided by law; provided, such grand juries are\n\ncomposed of citizens from each of the counties on a pro rata basis\n\nby county;\n\n20. To investigate any report by the State Auditor and\n\nInspector filed with the Attorney General pursuant to Section 223 of\n\nthis title and prosecute all actions, civil or criminal, relating to\n\nsuch reports or any irregularities or derelictions in the management\n\nof public funds or property which are violations of the laws of this\n\nstate;\n\n21. To represent and protect the collective interests of all\n\nutility consumers of this state in rate-related proceedings before\n\nthe Corporation Commission or in any other state or federal judicial\n\nor administrative proceeding;\n\n22. To represent and protect the collective interests of\n\ninsurance consumers of this state in rate-related proceedings before\n\nthe Insurance Commissioner or in any other state or federal judicial\n\nor administrative proceeding;\n\n23. To investigate and prosecute any criminal action relating\n\nto insurance fraud, if in the opinion of the Attorney General a\n\ncriminal prosecution is warranted, or to refer such matters to the\n\nappropriate district attorney;\n\n24. To monitor and evaluate any action by the federal\n\ngovernment including, but not limited to, executive orders by the\n\nPresident of the United States, rules or regulations promulgated by\n\nan agency of the federal government or acts of Congress to determine\n\nif such actions are in violation of the Tenth Amendment to the\n\nConstitution of the United States;\n\n25. To cross-deputize police officers of the police department\n\nof any municipality or any officer deputized by the county sheriff\n\nor a designee subject to an interlocal governmental agreement with\n\nthe Attorney General’s Office in an effort to combine city, county,\n\nand state law enforcement efforts and to encourage cooperation\n\nbetween city, county, and state law enforcement officials.\n\nLiability for the conduct of any municipal police officer cross-\n\ndeputized under the terms and conditions of an interlocal\n\ngovernmental agreement or any officer deputized by the county\n\nsheriff under the terms and conditions of an interlocal governmental\n\nagreement shall remain the responsibility of the respective employer\n\nfor that officer;\nen city, county, and state law enforcement officials.\n\nLiability for the conduct of any municipal police officer cross-\n\ndeputized under the terms and conditions of an interlocal\n\ngovernmental agreement or any officer deputized by the county\n\nsheriff under the terms and conditions of an interlocal governmental\n\nagreement shall remain the responsibility of the respective employer\n\nfor that officer;\n\n26. To maintain data related to human trafficking and to assist\n\nlaw enforcement, social service agencies, and victim services\n\nprograms in identifying and supporting victims of human trafficking;\n\nand\n\n27. To investigate and prosecute any civil or criminal action\n\nrelating to violations of the Oklahoma Open Records Act, Section\n\n24A.1 et seq. of Title 51 of the Oklahoma Statutes, or the Oklahoma\n\nOpen Meeting Act, Section 301 et seq. of Title 25 of the Oklahoma\n\nStatutes, if the Attorney General determines that a civil or\n\ncriminal prosecution is warranted or to defer such matters to a\n\ndistrict attorney.\n\nB. Nothing in this section shall be construed as requiring the\n\nAttorney General to appear and defend or prosecute in any court any\n\ncause or proceeding for or on behalf of the Oklahoma Tax Commission,\n\nthe Board of Managers of the State Insurance Fund, or the\n\nCommissioners of the Land Office.\n\nC. In all appeals from the Corporation Commission to the\n\nSupreme Court of Oklahoma in which the state is a party, the\n\nAttorney General shall have the right to designate counsel of the\n\nCorporation Commission as the Attorney General's legally appointed\n\nrepresentative in such appeals, and it shall be the duty of the\n\nCorporation Commission counsel to act when so designated and to\n\nconsult and advise with the Attorney General regarding such appeals\n\nprior to taking action therein.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2f3e3a99998910c2eda60c1884a3c8872da26b771b33827b7b3ca52f354e31ae","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-18a","next":"us-ok/okla.-stat.-tit.-74-74-18c"},"notice":"GroundRules: Original legal text.
