There is hereby created within the Office of the Attorney\n\nGeneral an Insurance Fraud Unit.\n\nB. The Insurance Fraud Unit, upon inquiry or complaint or upon\n\nreferral from the Insurance Department, shall determine the extent,\n\nif any, to which a violation has occurred of any statute or\n\nadministrative rule of this state pertaining to insurance fraud and\n\nmay initiate any necessary investigation, civil action, criminal\n\naction, referral to the Insurance Commissioner or Insurance\n\nDepartment, referral to a district attorney, or referral to any\n\nappropriate official of this or any other state or of the federal\n\ngovernment.\n\nC. In the absence of fraud, bad faith, reckless disregard for\n\nthe truth, or actual malice, no person, insurer, or agent of an\n\ninsurer shall be liable for damages in a civil action or subject to\n\ncriminal prosecution for supplying information about suspected\n\ninsurance fraud to the Insurance Fraud Unit of the Office of the\n\nAttorney General or any other agency involved in the investigation\n\nor prosecution of suspected insurance fraud.\n\nD.
