Effective July 1, 2005, all administrative rules promulgated\n\nby the Department of Mental Health and Substance Abuse Services\n\nrelating to domestic violence and sexual assault programs shall be\n\ntransferred to and become a part of the administrative rules of the\n\nOffice of the Attorney General. The Office of Administrative Rules\n\nin the Secretary of State’s office shall provide adequate notice in\n\nthe Oklahoma Register of the transfer of such rules, and shall place\n\nthe transferred rules under the Administrative Code section of the\n\nAttorney General. Such rules shall continue in force and effect as\n\nrules of the Office of the Attorney General from and after July 1,\n\n2005, and any amendment, repeal or addition to the transferred rules\n\nshall be under the jurisdiction of the Attorney General.\n\nB. The Attorney General shall adopt and promulgate rules and\n\nstandards for certification of batterers intervention and domestic\n\nviolence programs and for private facilities and organizations which\n\noffer domestic and sexual assault services in this state. These\n\nfacilities shall be known as \"certified domestic violence shelters\"\n\nor \"certified domestic violence programs\" or \"certified sexual\n\nassault programs\" or \"certified treatment programs for batterers\",\n\nas applicable.\n\nC. Applications for certification as a certified domestic\n\nviolence shelter, domestic violence program, sexual assault program\n\nor treatment program for batterers, pursuant to the provisions of\n\nthis section, shall be made to the Office of the Attorney General on\n\nprescribed forms. The Attorney General may certify the shelter or\n\nprogram for a period of three (3) years subject to renewal as\n\nprovided in the rules promulgated by the Attorney General. Nothing\n\nin this section shall preclude the Office of the Attorney General\n\nfrom making inspection visits to a shelter or program to determine\n\ncontract or program compliance.\n\nD. Licensed physicians, licensed psychologists, licensed social\n\nworkers, individual members of the clergy, licensed marital and\n\nfamily therapists, licensed behavioral practitioners, and licensed\n\nprofessional counselors shall be exempt from certification\n\nrequirements; provided, however, these exemptions shall only apply\n\nto individual professional persons in private practice and not to\n\nany domestic violence program or sexual assault program operated by\n\nsuch person.\n\nE. Facilities providing services for persons who commit\n\ndomestic abuse, victims or survivors of domestic abuse or sexual\n\nassault and any dependent children of such victims or survivors\n\nshall comply with standards promulgated by the Attorney General;\n\nprovided, that the certification requirements and standards\n\npromulgated by the Attorney General shall not apply to programs and\n\nservices offered by the Department of Health, the Department of\n\nMental Health and Substance Abuse Services, the Department of\n\nCorrections or the Department of Human Services. The batterers\n\nintervention, domestic violence or sexual assault programs certified\n\npursuant to the provisions of this section shall cooperate with\n\ninspection personnel of this state and shall promptly file all\n\nreports required by the Attorney General. Failure to comply with\n\nrules and standards of the Attorney General shall be grounds for\n\nrevocation of certification, after proper notice and hearing.\n\nF.
