Stat. tit. 74, § 74-19","heading":"Attorney General's Evidence Fund and Revolving Fund -","body":"Invoicing retirement funds for attorney fees.\n\nA. 1. Out of all money received or collected by the Attorney\n\nGeneral on behalf of the state or any department or agency thereof,\n\nand paid into the State Treasury, twenty-five percent (25%) thereof\n\nshall be deposited as follows: three-fourths (3/4) in a special\n\nagency account fund in the State Treasury, designated the Attorney\n\nGeneral's Evidence Fund, which fund shall be a continuing fund, not\n\nsubject to fiscal year limitations, and one-fourth (1/4) in the\n\nAttorney General's Revolving Fund created by Section 20 of this\n\ntitle. Provided, however, these provisions shall not apply to any\n\nmonies paid to the State of Oklahoma as a result of the settlement\n\nof the lawsuit filed by the State of Oklahoma against the tobacco\n\nindustry.\n\n2. All money paid to the Attorney General for reimbursement of\n\ncourt costs, fees and other expenses and appropriated monies\n\nauthorized to be transferred to the agency special account shall be\n\ndeposited in the Attorney General's Evidence Fund. Such fund shall\n\nbe used by the Attorney General for necessary expenses relative to\n\nany pending case or other matter within the official responsibility\n\nof the Attorney General.\n\nB. All money received or credited by the Attorney General on\n\nbehalf of the Teachers' Retirement System of Oklahoma, the Oklahoma\n\nPublic Employees Retirement System, the Oklahoma Firefighters\n\nPension and Retirement System, the Oklahoma Police Pension and\n\nRetirement System, the Oklahoma Law Enforcement Retirement System or\n\nthe Uniform Retirement System for Justices and Judges shall be paid\n\nto the State Treasurer of the state and distributed to the\n\nappropriate fund of the respective retirement system as directed by\n\nthe board of trustees of said respective retirement system. The\n\nAttorney General shall invoice the respective retirement system and\n\nthe respective retirement system shall pay for reasonable attorney's\n\nfee for actual legal services rendered by the Attorney General's\n\noffice related to the money received or credited on behalf of the\n\nrespective retirement system based on an hourly rate determined by\n\nthe Attorney General. The hourly rate charged by the Attorney\n\nGeneral to a retirement system for services related to the\n\ncollection of money received or credited on behalf of the respective\n\nretirement system shall be based on the labor, time and problems\n\ninvolved, the skill and expertise called for in the performance of\n\nthe services and the standing of the specific attorney or attorneys\n\ninvolved. The hourly rate charged by the Attorney General to a\n\nretirement system shall not be based on the value of the property at\n\nissue or recovered. The Attorney General shall not separately\n\ninvoice a retirement system for the work performed by an attorney\n\nemployed by the Attorney General's office whose salary and other\n\nrelated costs are paid in part or in whole by said retirement system\n\npursuant to an agreement entered into between the Attorney General\n\nand the retirement system for legal services.\n\nC. From any monies paid to the State of Oklahoma representing\n\nattorney fees, paralegal fees and other costs of litigating the\n\nlawsuit filed by the State of Oklahoma against the tobacco industry,\n\nthe Attorney General shall make such deposits as are appropriate\n\npursuant to subsection A of this section.
