Stat. tit. 74, § 74-192","heading":"Short title – Oklahoma Jail Standards Act – Inspections of","body":"detention facilities.\n\nA. This act shall be known and may be cited as the “Oklahoma\n\nJail Standards Act”. The State Commissioner of Health shall\n\npromulgate rules to implement the provisions of the Oklahoma Jail\n\nStandards Act.\n\nB. Except as provided in this section, all detention facilities\n\nand lockup facilities shall operate in compliance with the\n\nprovisions of the Oklahoma Jail Standards Act.\n\nC. The State Department of Health shall inspect at least once\n\neach year all detention facilities to ensure compliance with the\n\nstandards set forth in the Oklahoma Jail Standards Act.\n\nInspections shall be limited to the specific requirements set\n\nforth in the Oklahoma Jail Standards Act or rules promulgated\n\npursuant thereto.\n\nD. In the event such inspection shall reveal to the Department\n\nthe commission of a crime or crimes incidental to the operations of\n\na detention facility, it shall be the duty of the Department to\n\ninitiate a complaint with the appropriate district attorney and to\n\ncooperate in the prosecution of the alleged offender in the event an\n\ninformation is filed pursuant to such complaint.\n\nE. The provisions of the Oklahoma Jail Standards Act shall be\n\nsubject to the following exceptions and limitations:\n\n1. Any county, city, or town may operate a holding facility for\n\nthe incarceration of persons under arrest who are to be charged with\n\na crime, which holding facility shall not be required to meet the\n\nstandards established in the Oklahoma Jail Standards Act, as long as\n\nno person is held therein for a period longer than twelve (12) hours\n\nand as long as an employee of the county, city, or town is available\n\nto render aid to or to release any person so confined in the event\n\naid or release is required because of a health or life-endangering\n\nemergency;\n\n2. Notwithstanding any other provision of law or rule, any\n\ncounty or municipality that operates a detention facility which\n\nhouses forty or fewer prisoners at all times which:\n\na. provides twenty-four-hour supervision of prisoner\n\nactivity that is conducted either by direct\n\nobservation or electronically by video surveillance,\n\nand\n\nb. provides an intercommunication system that terminates\n\nin a location that is staffed twenty-four (24) hours a\n\nday and is capable of providing an emergency response,\n\nshall not be required to have more than one detention officer on-\n\nsite to provide for the security, custody, and supervision of\n\nprisoners. Staff shall be available to perform sensitive functions\n\nand procedures as necessary to accommodate inmate gender as required\n\nby law;\n\n3. Any county or municipality that operates a detention\n\nfacility which houses more than forty and less than seventy-five\n\nprisoners at all times which:\n\na. provides twenty-four-hour supervision of prisoner\n\nactivity that is conducted either by direct\n\nobservation or electronically by video surveillance,\n\nand\n\nb. provides an intercommunication system that terminates\n\nin a location that is staffed twenty-four (24) hours a\n\nday and is capable of providing an emergency response,\n\nshall be required to have more than one detention officer or one\n\ndetention officer and at least one other basic CLEET-certified\n\nperson on the same premises as the detention facility to provide for\n\nthe security, custody, and supervision of prisoners. Staff shall be\n\navailable to perform sensitive functions and procedures as necessary\n\nto accommodate inmate gender as required by law;\n\n4. A county, municipality, or public trust that operates a\n\ndetention facility may request a waiver, including a waiver for a\n\ntemporary emergency resulting from a natural or man-made disaster,\n\nfrom provisions of the Oklahoma Jail Standards Act or rules\n\npromulgated pursuant thereto upon a showing that application of such\n\nprovision would impose undue hardship upon the county, municipality,\n\nor public trust, or upon the inmates held at such facility. All\ndetention facility may request a waiver, including a waiver for a\n\ntemporary emergency resulting from a natural or man-made disaster,\n\nfrom provisions of the Oklahoma Jail Standards Act or rules\n\npromulgated pursuant thereto upon a showing that application of such\n\nprovision would impose undue hardship upon the county, municipality,\n\nor public trust, or upon the inmates held at such facility. All\n\nrequests shall be filed with the Department and shall include\n\njustification demonstrating the undue hardship. The waiver\n\napplication shall also include a plan for the housing and care of\n\ndetention facility inmates for the duration of the waiver and\n\nidentification of all specific provisions of the Oklahoma Jail\n\nStandards Act requested to be waived. The Department may grant the\n\nwaiver request in whole or in part and may, as a condition of\n\ngranting the waiver, require the county, municipality, or public\n\ntrust to submit a plan and timetable for compliance with the\n\nstandards. The Commissioner shall promulgate rules to implement the\n\nwaiver process established by this paragraph; and\n\n5. Any detention facility that is constructed or substantially\n\nremodeled shall be required to be in compliance with the\n\nrequirements and standards in effect at the time of such\n\nconstruction or remodeling. Plans for the construction of a new\n\ndetention facility or the substantial remodeling of an existing\n\ndetention facility shall be submitted to the Department for review\n\nand approval.\n\nF. The Department shall employ inspectors and other personnel\n\nas necessary and specifically authorized by the Legislature in order\n\nto carry out the provisions of the Oklahoma Jail Standards Act and\n\nmay rent or purchase premises or equipment in order to assist\n\ninspectors in the performance of their functions.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cef43e7c4e32e0b304c30114da114b83801252abf1ee793e228a46d1a9da175c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-1910","next":"us-ok/okla.-stat.-tit.-74-74-192.1"},"notice":"GroundRules: Original legal text.
