A juvenile shall be incarcerated only in a detention\n\nfacility authorized by the appropriate judicial or juvenile bureau\n\nauthority. A juvenile shall not be detained in any holding facility\n\nor lockup facility. This requirement shall not preclude juveniles\n\nfrom being held in nonsecure areas until a parent or other\n\nresponsible party arrives to take custody of the juvenile.\n\nB. Prior to a juvenile being placed in an eligible detention\n\nfacility, permission shall be obtained from the appropriate judicial\n\nor juvenile bureau authority. A record of permission shall be\n\nmaintained at the facility.\n\nC. Sight checks of juvenile inmate living areas shall be\n\nperformed at least one time each hour. The check shall include all\n\nareas of each cell and the juvenile inmates shall be visually\n\nobserved. Checks shall be documented in writing on a form provided\n\nby the facility administrator.\n\nD. An adult inmate who is assigned trustee status shall not be\n\npermitted sustained contact with a juvenile inmate. A staff member\n\nshall serve all meals to a juvenile inmate.\n\nE. In addition to existing visitation privileges, juvenile\n\ninmates shall be permitted visits from authorized juvenile agency\n\npersonnel. Visits from family members who are unable to visit\n\nduring normal visiting hours shall be allowed so long as\n\narrangements are made in advance with the administrator and provided\n\nthe visit does not jeopardize facility security. Each facility that\n\nholds a juvenile shall have written policies for such visits.\n\nF. A juvenile inmate shall be able to communicate with staff\n\nmembers at all times. Such communication may be either by voice or\n\nelectronic means. If electronic systems are used, there shall be a\n\nbackup plan to insure communication ability is maintained.\n\nG. No staff member shall be permitted to enter a juvenile\n\ninmate living area without backup assistance being available from\n\nanother staff member. At least one staff member shall be of the\n\nsame gender as the juvenile inmate except in life-endangering or\n\nlife-threatening situations. Any time a decision is made to enter\n\nthe living area without appropriate backup assistance as defined\n\nherein, the action shall be documented. Documentation shall show\n\nthe reason for the decision and a permanent record shall be\n\nmaintained.\n\nH. A juvenile charged with a crime which would constitute a\n\nfelony if committed by an adult or a juvenile who is an escapee from\n\na juvenile training school or from a Department of Human Services\n\ngroup home may be detained in any detention facility authorized by\n\nthe appropriate judicial or juvenile bureau authority, police\n\nstation, or similar law enforcement office not approved for long-\n\nterm detention, for a period of six (6) hours or less for\n\nidentifying, processing, or arranging for transfer to a juvenile\n\ndetention facility or alternative program. In no other\n\ncircumstances shall a juvenile be securely detained in an adult\n\ndetention facility.\n\nI. The State Department of Health shall coordinate with the\n\nOffice of Juvenile Affairs to certify detention facilities for\n\nholding juvenile offenders based on the compliance of the detention\n\nfacility with the Oklahoma Jail Standards Act and the provisions of\n\nSection 2-3-103 of Title 10A of the Oklahoma Statutes.\n\nJ. The designation of a detention facility as a place for the\n\ndetention of juveniles shall be made from a list of eligible\n\ndetention facilities supplied by the Department. Eligible detention\n\nfacilities shall be those detention facilities deemed by the\n\nDepartment as compliant with the Oklahoma Jail Standards Act.\n\nK. Any adult detention, holding, or lockup facility shall\n\nrecord and report the detention of any person eighteen (18) years of\n\nage or younger in a manner consistent with the requirements of the\n\nOffice of Juvenile Affairs.\n\nties shall be those detention facilities deemed by the\n\nDepartment as compliant with the Oklahoma Jail Standards Act.\n\nK. Any adult detention, holding, or lockup facility shall\n\nrecord and report the detention of any person eighteen (18) years of\n\nage or younger in a manner consistent with the requirements of the\n\nOffice of Juvenile Affairs.\n\nL. Records of detention for persons eighteen (18) years of age\n\nor younger and detained in the last year shall be subject to review\n\nduring the annual inspection conducted by the Department.\n\nM. If detention of a juvenile is authorized, such juvenile\n\nshall be housed separately from adults in order to prohibit\n\nsustained sight and sound contact. Inadvertent contact with\n\nincarcerated adults outside of detention facility living areas not\n\ndedicated for use by juvenile offenders should be minimized.\n\nN. A juvenile may be held for up to six (6) hours for the\n\npurpose of identification, investigation, processing, release to a\n\nparent, transfer to court, or transfer to a juvenile facility\n\nfollowing the initial custody of the juvenile.\n\nO. A juvenile arrested for or charged with a criminal offense\n\nmay be securely detained in an adult detention or lockup facility\n\nfor up to six (6) hours immediately before or immediately after a\n\ncourt appearance, provided sight and sound separation is maintained.\n\nThis period may be extended to twenty-four (24) hours, excluding\n\nweekends and holidays, if the jurisdiction is outside the\n\nmetropolitan statistical area where:\n\n1. State law requires an initial court appearance within\n\ntwenty-four (24) hours after being taken into custody;\n\n2. There is no acceptable alternative placement; and\n\n3.
