Stat. tit. 74, § 74-194","heading":"Deficient facility - Closing","body":"If the deficiencies listed in the report have not been\n\ncorrected, within sixty (60) days after delivery of the report, the\n\nCommissioner of Health shall be authorized to file a complaint with\n\nthe Attorney General or the district attorney for the purpose of\n\nassistance in obtaining compliance or to close the deficient\n\nfacility. Provided, that upon demonstration of a good-faith effort\n\nby the governmental entity involved to correct said deficiencies and\n\nachieve compliance with the established standards, the Commissioner\n\nof Health shall extend the time for compliance a reasonable period\n\nbefore filing the complaint requesting assistance in obtaining\n\ncompliance or the closing of the facility. An action to close such\n\nfacility shall be brought in the district court having jurisdiction\n\nin the county in which the facility is located. Upon the issuance\n\nof an order by the district court to close the facility, the\n\nfacility shall be closed and prisoners shall be removed to a\n\nsuitable facility at the expense of the governmental entity\n\nresponsible for the facility ordered closed.
