Stat. tit. 74, § 74-20j","heading":"Enforcement of federal immigration and customs laws -","body":"Memorandum of Understanding - Limitation of exchange of information\n\nregarding immigration status prohibited - Private right of action.\n\nA. The Attorney General is authorized and directed to negotiate\n\nthe terms of a Memorandum of Understanding between the State of\n\nOklahoma and the United States Department of Justice or the United\n\nStates Department of Homeland Security, as provided by Section\n\n1357(g) of Title 8 of the United States Code, concerning the\n\nenforcement of federal immigration and customs laws, detention and\n\nremovals, and investigations in the State of Oklahoma.\n\nB. The Memorandum of Understanding negotiated pursuant to\n\nsubsection A of this section shall be signed on behalf of this state\n\nby the Attorney General and the Governor or as otherwise required by\n\nthe appropriate federal agency.\n\nC. No local government, whether acting through its governing\n\nbody or by an initiative, referendum, or any other process, shall\n\nenact any ordinance or policy that limits or prohibits a law\n\nenforcement officer, local official, or local government employee\n\nfrom communicating or cooperating with federal officials with regard\n\nto the immigration status of any person within this state.\n\nD. Notwithstanding any other provision of law, no government\n\nentity or official within the State of Oklahoma may prohibit, or in\n\nany way restrict, any government entity or official from sending to,\n\nor receiving from, the United States Department of Homeland\n\nSecurity, information regarding the citizenship or immigration\n\nstatus, lawful or unlawful, of any individual.\n\nE. Notwithstanding any other provision of law, no person or\n\nagency may prohibit, or in any way restrict, a public employee from\n\ndoing any of the following with respect to information regarding the\n\nimmigration status, lawful or unlawful, of any individual:\n\n1. Sending such information to, or requesting or receiving such\n\ninformation from, the United States Department of Homeland Security;\n\n2. Maintaining such information; or\n\n3. Exchanging such information with any other federal, state,\n\nor local government entity.\n\nF.
