Stat. tit. 74, § 74-2107","heading":"Qualification as expert trading company - Procedure -","body":"Rules and regulations - Orders - Violation of act.\n\nA. Any corporation proposing to qualify as an export trading\n\ncompany pursuant to the provisions of the Export Trading Company Act\n\nshall file an application for approval with the Commission. The\n\napplication shall contain the names of the shareholders and\n\nprincipal officers of the applicant and such other information as\n\nthe Commission may by regulation require, and shall specifically\n\nacknowledge the applicant's agreement to be bound by the conditions\n\nset forth in the rules and regulations issued pursuant to this\n\nsection.\n\nB. 1. In determining whether to approve an application for\n\nqualification as an export trading company and to certify such\n\nexport trading company as a qualified export trading company, the\n\nCommission shall consider whether:\n\na. the stated purposes of the corporation satisfy the\n\nbasic aim of encouraging and expanding export trade;\n\nb. the activities undertaken in this state will be a\n\nsignificant factor in, or contribute significantly to\n\nencouraging export trade;\n\nc. the tax exemptions provided for in Section 6 of this\n\nact will serve as a significant incentive and aid to\n\nencouraging export trade; and\n\nd. export trade opportunities will be improved and\n\ninitiated, particularly for small and medium-sized\n\nproducers, by creation of an export trading company.\n\n2. No successor corporation of a qualified export trading\n\ncompany shall be certified as a qualified export trading company if\n\nthe names of the shareholders and the principal officers of such\n\nsuccessor corporation are the same as those of the qualified export\n\ntrading company.\n\nC. 1. The Oklahoma Tax Commission shall promulgate such rules\n\nand regulations as may be necessary to implement the provisions of\n\nthe Export Trading Company Act and to safeguard against abuses of\n\nthe Export Trading Company Act. Such rules and regulations shall\n\ninclude a prohibition against the stacking of tax exemptions\n\nprovided for in Section 2106 of this title.\n\n2. The Commission may issue orders pursuant to the provisions\n\nof the Export Trading Company Act in order to:\n\na. prescribe information or forms required in connection\n\nwith an application; and\n\nb. establish procedures in connection with approvals and\n\nthe filing of required reports.\n\nD. The Commission, upon the determination that any export\n\ntrading company is in violation of any provisions of the Export\n\nTrading Company Act or regulations, rules, or orders issued pursuant\n\nto the Export Trading Company Act, may order the export trading\n\ncompany to take steps to remedy such violation or disqualify said\n\ncompany as an export trading company.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"90a28e0e8389e760ed1b8a8351b5a51a7dee75bced7c1623b5edbb50d63256a0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-2106","next":"us-ok/okla.-stat.-tit.-74-74-2108"},"notice":"GroundRules: Original legal text.
