The Oklahoma Tourism and Recreation Commission is encouraged\n\nto explore the potential benefits of not-for-profit foundations for\n\nsupport of state parks. Such support from a not-for-profit\n\nfoundation shall not substitute for the obligation of the state to\n\nsupport the natural resources infrastructure of the state, but shall\n\nserve only as a supplement to state funding and as a means to\n\nfurther assist the Oklahoma Tourism and Recreation Department in\n\npreserving the natural resources and historical, educational, and\n\ncultural facilities of significance in the state.\n\nB. There is hereby authorized the establishment of a not-for-\n\nprofit state park foundation for the purpose of encouraging\n\ncontributions by private individuals, companies, foundations,\n\ncorporations, and others in the private and public sectors.\n\nContributions shall be utilized for the support, preservation, and\n\ndevelopment of state park properties. This support, preservation,\n\nand development shall include, but is not limited to, preservation\n\nof historic facilities, development of educational and interpretive\n\nprograms, materials, and other means of support.\n\nC. As used in this section, a “state park foundation” means any\n\ncompany, trust, corporation, or association:\n\n1. That solicits money or property in the name of any state\n\npark under the jurisdiction of the Commission; and\n\n2. Which is exempt from federal income taxes.\n\nD. The Commission may refuse to accept any grant, award, or\n\ndonation of real or personal property offered by or through a state\n\npark foundation.\n\nE. No employee of the Department shall be a voting member of a\n\nstate park foundation board. Members of the Commission may serve on\n\nthe board of a state park foundation, but shall not constitute a\n\nmajority of the members of the board of the foundation. No member\n\nof the Commission serving on the board or an employee of the\n\nDepartment serving as an ex officio member of the board shall be\n\ncompensated by the foundation for service as a member of the\n\nfoundation board.\n\nF. A state park foundation created pursuant to this section\n\nshall not be an entity of state government.
