The Department may place uncollectible accounts receivable\n\nin a special account for accounting and budgetary purposes. An\n\n\"uncollectible account receivable\" shall have been uncollectible or\n\ndue for at least one (1) year and possess at least one of the\n\nfollowing characteristics:\n\n1. The debtor has been discharged from bankruptcy or is\n\ninsolvent;\n\n2. The debtor cannot be found or is deceased; or\n\n3. A collection agency has indicated its inability to collect\n\nthe debt.\n\nB. If uncollectible accounts receivable are placed in a special\n\naccount, the following procedures shall be observed:\n\n1. The proposed uncollectible accounts shall be forwarded to\n\nthe Department by the appropriate divisions. The Department shall\n\nthen submit the accounts to the Commission and to the State Auditor\n\nand Inspector once each fiscal year for placement into the special\n\nuncollectible account; and\n\n2. The Commission and the State Auditor and Inspector shall\n\ncertify those accounts which meet the requirements of this section\n\nas \"uncollectible accounts receivable\" and shall place those\n\naccounts in the special account created by this section.\n\nC. The special uncollectible accounts receivable account shall\n\nnot be used for budgetary purposes in determining the assets of the\n\nDepartment or any of its divisions.
