The Commission shall be vested with the responsibility and\n\nauthority to:\n\n1. Plan, purchase, develop, construct, maintain, operate and\n\nprotect the state trails system and shall prescribe the uses and\n\nlimits of each designated trail; and\n\n2. Acquire, by lease, deed or contract, rights-of-way or\n\neasements of trails across private, municipal, county, state or\n\nfederal lands. In selecting the rights-of-way, every effort will be\n\nmade to minimize any adverse effects on the adjacent landowner or\n\nuser and his operations. Acquisition shall be, whenever possible,\n\nin the form of an easement obtained by gift, exchange or purchase\n\nwith donated funds. In cases where these attempts fail, the\n\nCommission may authorize the expenditure of state trail funds for\n\nacquisition in fee. Any agreement for acquisition of rights in land\n\nshall be for terms of not less than twenty-five (25) years whenever\n\npossible.\n\nB. The Commission may abandon any portion or all of a trail or\n\neasement acquired for trail purposes; or it may transfer any trail\n\nor easement to a local government having jurisdiction over the area\n\nin which the trail or easement is located, provided that such local\n\ngovernment agrees to maintain and operate the trail.\n\nC. The Commission shall notify the owner of the land, through\n\nwhich any trail or easement passes, prior to entering into any\n\nagreement with local government for the operation of a trail and\n\nshall secure the consent of the landowner prior to the transfer of\n\nany trail or easement to a local government.\n\nD. The Commission shall review all formal declarations of\n\nrailroad rights-of-way abandonment for possible inclusion into the\n\nstate trails system.\n\nE. Within the boundaries of a right-of-way, the Commission may\n\nacquire, on behalf of the state, lands in fee title, any interest in\n\nlands in the form of scenic or other easements or any interest in\n\nlands under cooperative or other agreement. Acquisition of land or\n\nof any interest in land may be by gift, purchase or exchange.\n\nAcquisition may be through the use of funds obtained by donation,\n\nfederal grants, legislative appropriation or otherwise. In\n\nacquiring real property or any interest therein, the power of\n\neminent domain shall not be used.\n\nF. 1. The Commission shall encourage the provision of bicycle\n\nroutes within the rights-of-way of federal aid system highways and\n\non or along county and city roadways. These bicycle routes shall be\n\ncomposed of three types of pathways: bicycle trails, bicycle lanes\n\nand bicycle routes. Bicycle trails shall be distinct pathways which\n\nseparate bicycles from motorized vehicular traffic by means of an\n\nopen space or barrier. Bicycle lanes shall use designated portions\n\nof existing roadways and will be clearly marked and separated from\n\nautomobile lanes. Bicycle routes shall be existing, low-volume\n\nroads and will be designated by clearly marked signs.\n\n2. Prior to the designation and construction of the bicycle\n\npathway system, the Commission shall authorize the development of a\n\nbicycle master plan. The plan shall be comprised of a set of\n\nclearly defined goals, a statement of current and projected demands,\n\na proposed layout of routes, construction specifications, cost\n\nprojections and the scheduling of implementation. The plan shall\n\nlikewise devote serious consideration to those design criteria which\n\nwill help to ensure the safety of bicyclist, pedestrian and motorist\n\nalike.\n\n3.
