Stat. tit. 74, § 74-3007","heading":"State or agency to procure a product or service at fair","body":"market price.\n\nA. Whenever this state or any of its agencies intends to\n\nprocure any product or service included in the procurement schedule,\n\nthat entity shall secure the product or service from a qualified\n\nnonprofit agency providing employment to people with significant\n\ndisabilities at the fair market price determined by the Office of\n\nManagement and Enterprise Services Central Purchasing Division, if\n\nthe product or service is available within the period required by\n\nthe entity and meets the specifications of the entity.\n\nB. An agency of this state shall not evade the intent and\n\nmeaning of this section by slight variations from standards adopted\n\nby the Office of Management and Enterprise Services Central\n\nPurchasing Division.\n\nC. Provided, the requirements of this section shall not apply\n\nto the procurement of janitorial services by the Oklahoma State\n\nBureau of Investigation. The Bureau shall conduct background\n\ninvestigations and national criminal history record checks on\n\ncompanies and individuals with which it contracts to provide\n\njanitorial services.\n\nD. Any municipality or county agency of this state is\n\nauthorized to purchase products and services from any qualified\n\norganization as defined in Section 3003 of this title. The\n\nqualified organization shall be able to meet the needs and\n\nspecifications for the products or services required by the\n\npurchasing body at the fair market price.
