Stat. tit. 74, § 74-3122","heading":"Agency reports of all Memorandums of Understanding or","body":"Memorandums of Agreement.\n\nA. For purposes of the Government Transparency Act of 2019,\n\n\"state agency\" shall have the same meaning pursuant to Section 3301\n\nof Title 74 of the Oklahoma Statutes.\n\nB. Upon the effective date of this act, a state agency entering\n\ninto a Memorandum of Understanding or Memorandum of Agreement with\n\nany agency, department or any organization receiving appropriated\n\nmoney, grants, contracts from the State of Oklahoma or any other\n\nstate or funds from the government of the United States shall\n\npublish a report on its website and the documents.ok.gov website of\n\nall Memorandums of Understanding or Memorandums of Agreement within\n\nfifteen (15) business days of the Memorandum's effective date. The\n\nreport shall contain a detailed accounting of each Memorandum of\n\nUnderstanding or Memorandum of Agreement which shall include:\n\n1. The effective date of the Memorandum of Understanding or\n\nMemorandum of Agreement;\n\n2. The duration of the Memorandum of Understanding or\n\nMemorandum of Agreement;\n\n3. The entities subject to the Memorandum of Understanding or\n\nMemorandum of Agreement;\n\n4. The purpose of the Memorandum of Understanding or Memorandum\n\nof Agreement; and\n\n5. The constitutional or statutory provisions allowing for the\n\nsubject addressed in the Memorandum of Understanding or Memorandum\n\nof Agreement.\n\nC. When any state agency enters into a Memorandum of\n\nUnderstanding or Memorandum of Agreement, and when the state\n\nLegislature is in session, the state agency shall provide the chair\n\nof the appropriate legislative committee, based on the subject\n\nmatter or agency executing the document, with a copy of the\n\nMemorandum of Understanding or Memorandum of Agreement.\n\nD. Provided, the state agency may not publish any such report\n\non a Memorandum of Understanding or Memorandum of Agreement that is\n\nprivileged under law pursuant to the Oklahoma Open Records Act.\n\nHowever, a report shall still be published to indicate what entities\n\nare subject to the privileged Memorandum of Understanding or\n\nMemorandum of Agreement and its duration.\n\nE. Memorandums of Understanding or Memorandums of Agreement\n\nsolely between departments or agencies of this state shall cite the\n\nstate constitutional or statutory authority granted for the subject\n\naddressed in the Memorandum of Understanding or Memorandum of\n\nAgreement. Memorandums of Understanding or Memorandums of Agreement\n\nbetween any agencies, departments and any organizations receiving\n\nappropriated money, grants, contracts from the State of Oklahoma or\n\nany other state, or funds from the government of the United States\n\nshall cite the authority granted by federal or state statute and/or\n\nin the Constitution of the United States as well as the Constitution\n\nof the State of Oklahoma for the subject addressed in the Memorandum\n\nof Understanding or Memorandum of Agreement.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1a204ad9c0f63ca0d34987b5d151485884aa786b8a0062f96337a1633783c6ff","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-3121","next":"us-ok/okla.-stat.-tit.-74-74-314"},"notice":"GroundRules: Original legal text.
