Stat. tit. 74, § 74-316","heading":"Witnesses and evidence - Administration of oath or","body":"affirmations - Punishment for contempt - Prosecutions - Right of\n\nentry.\n\nThe State Fire Marshal and the Assistant Fire Marshal shall each\n\nhave power in any county in the State of Oklahoma to summons and\n\ncompel the attendance of witnesses before them, or either of them,\n\nto testify in relation to any matter which by any of the provisions\n\nof this act is made a subject of inquiry and investigation and may\n\nrequire the production of any books, papers or documents deemed\n\npertinent thereto by them, or either of them. Said State Fire\n\nMarshal, Assistant Fire Marshal are each hereby authorized and\n\nempowered to administer oaths or affirmations to any person\n\nappearing as witness before them and false swearing in any matter or\n\nproceedings aforesaid shall be the felony of perjury and shall be\n\npunished as such. Any witness who refuses to be sworn or refuses to\n\ntestify or who disobeys any lawful order of the said State Fire\n\nMarshal, Assistant State Fire Marshal, or who fails or refuses, to\n\nproduce any book, paper or document, touching on any matter under\n\nexamination, or who is guilty of any contemptuous conduct after\n\nbeing summoned by them or either of them, to appear before them, or\n\neither of them, to give testimony in relation to any matter or\n\nsubject under investigation as aforesaid, shall be deemed guilty of\n\na misdemeanor and it shall be the duty of the State Fire Marshal,\n\nAssistant State Fire Marshal, or either of them to make complaint\n\nagainst said person or persons so refusing to comply with the\n\nsummons or order of the said State Fire Marshal, or Assistant State\n\nMarshal, before any justice of the peace, police magistrate, or any\n\ncourt of record in the county in which said investigation is being\n\nhad, and upon the filing of such complaint such court shall proceed\n\nin the same manner as other criminal cases and upon conviction of\n\nany such person guilty of violation of the provisions of this act,\n\nshall be fined in a sum of not exceeding Twenty-five Dollars\n\n($25.00) and imprisonment until such fine is paid; provided,\n\nhowever, that any person so convicted shall have the right of\n\nappeal. Said State Fire Marshal and his subordinates or either of\n\nthem shall have the authority at all times of day or night in the\n\nperformance of the duties imposed by the provisions of this act, to\n\nenter upon and examine any building or premises where any fire has\n\noccurred and other buildings adjoining or near the same. All\n\ninvestigations held by or under the direction of the said State Fire\n\nMarshal, may, in his discretion be private, and persons other than\n\nthose required to be present by the provisions of this act, may be\n\nexcluded from the place where such investigation is held and\n\nwitnesses may be kept separate and apart from each other and not be\n\nallowed to communicate with each other until they have been\n\nexamined.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4e8335c6132136875321fea8355375fc89a3b49a80c785d45f1875103b88fb6c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-315","next":"us-ok/okla.-stat.-tit.-74-74-317"},"notice":"GroundRules: Original legal text.
