Stat. tit. 74, § 74-324.11a","heading":"Smoke detectors required for certain buildings -","body":"Testing by lessees - New construction or remodeling - Penalties.\n\nA. Any person, partnership, corporation, organization, the\n\nstate, or city, town, county, or other subdivision of this state,\n\nowning a building or structure used as a hospital, church, theater,\n\nhotel, motel, apartment house, rooming house, dormitory, rest home,\n\nnursing home, day nursery, convalescent home, auditorium, or child\n\ncare institution, existing or constructed in the State of Oklahoma,\n\nshall install in such building or structure a smoke detector or\n\ndetectors in accordance with the nationally recognized codes,\n\nstandards, or practices adopted by the State Fire Marshal Commission\n\nto safeguard life and property from the hazards of smoke and fire.\n\nB. For the purpose of this section, the term smoke detector\n\nmeans a device which is:\n\n1. Designed to detect visible or invisible products of\n\ncombustion;\n\n2. Designed with an alarm audible to the rooms it serves;\n\n3. Powered by either battery, alternating current, or other\n\npower source; and\n\n4. Tested and listed for use as a smoke detector by a\n\nrecognized testing laboratory.\n\nC. Any person, partnership, corporation, state, municipality,\n\ncounty, or other subdivision of this state who is a lessor of a\n\nresidential rental property shall explain to the lessee or tenant\n\nthe method of testing the smoke detector to ensure that it is in\n\nworking order. The responsibility for checking a smoke detector to\n\nfind out whether such detector is in working order is with the\n\ntenant or lessee leasing or renting a one- or two-family dwelling,\n\nincluding an apartment in each apartment house, and not with the\n\nperson, partnership, corporation, state, municipality, county, or\n\nother subdivision of this state who is a lessor of the residential\n\nrental property to the lessee or tenant.\n\nD. Beginning November 1, 1997, all new construction or\n\nremodeling of residential dwellings which require a building permit\n\nshall include the installment of smoke detectors or the electrical\n\nwiring necessary for the installment of electrical smoke detectors.\n\nE. Any person who violates any provision of subsection A of\n\nthis section or any person who tampers with, removes, destroys,\n\ndisconnects or removes power from any installed smoke detector,\n\nexcept in the course of inspection, maintenance or replacement of\n\nthe detector, upon conviction, is guilty of a misdemeanor and may be\n\nfined not less than Fifty Dollars ($50.00) nor more than One Hundred\n\nDollars ($100.00).\n\nF. Nothing in this section shall be construed to allow any\n\npolitical subdivision in this state to enact laws imposing upon\n\nowners of any dwelling described in subsection A of this section a\n\ngreater duty with regard to the installation, testing, repair and\n\nreplacement of smoke detectors than is required by this section.\n\nG. The State Fire Marshal Commission shall prescribe, adopt,\n\nand promulgate the rules necessary to effectuate the provisions of\n\nthis section which shall include a practical time table for\n\ncompliance with the provisions of this act.\n\nH.
