Stat. tit. 74, § 74-325.20","heading":"Mobile food preparation vehicles — Fire code","body":"compliance.\n\nA. All mobile food preparation vehicles operating within this\n\nstate prior to July 1, 2024, that are capable of producing smoke or\n\ngrease-laden vapors shall be in compliance with the most current\n\nadopted fire code. With the exception of an automatic fire\n\nextinguishing system, such requirement shall apply to vehicles\n\nincluding, but not limited to, vehicles utilizing electric energy,\n\nliquefied petroleum gas, compressed natural gas, or a combination\n\nthereof for cooking, provided that portable fire extinguishers are\n\ninstalled and maintained in accordance with the most current version\n\nof NFPA 10: Standard for Portable Fire Extinguishers. A six-liter\n\nClass K-rated, portable fire extinguisher is required for all\n\ncooking equipment involving solid fuels, vegetable or animal oils\n\nand fats, or a combination thereof. All portable fire extinguishers\n\nshall be in clear view and immediately available for use.\n\nB. All mobile food preparation vehicles utilizing, handling, or\n\ntransporting liquefied petroleum gas or any liquefied petroleum gas\n\nsystem, equipment, container, apparatus, or appliance shall receive\n\nand maintain a permit from, and be inspected annually by, the\n\nOklahoma Liquefied Petroleum Gas Administration or its employees, in\n\nconjunction with the State Fire Marshal issuing an annual operation\n\npermit decal to mobile food preparation vehicles.\n\nC. The provisions in subsection A of this section shall expire\n\non January 1, 2026, and all mobile food preparation vehicles shall\n\ncomply with the most current adopted fire codes set forth by this\n\nstate.\n\nD. Mobile food preparation vehicles shall be under the\n\njurisdiction of the State Fire Marshal for fire and life safety code\n\ncompliance and shall be inspected annually by the State Fire Marshal\n\nto ensure compliance with the latest version of the state-adopted\n\nminimum codes for fire and life safety as adopted by the Oklahoma\n\nUniform Building Code Commission. The State Fire Marshal shall\n\ncoordinate, at minimum, annual inspections conducted:\n\n1. Within each of the four quadrants of this state; and\n\n2. Twice within each county with a population exceeding four\n\nhundred thousand (400,000) according to the latest Federal Decennial\n\nCensus.\n\nE. Upon approval, the State Fire Marshal shall issue an\n\noperational permit decal indicating that the vehicle meets the\n\nminimum fire and life code requirements adopted at the time of\n\ninspection.\n\nF. Nothing in this section shall prevent:\n\n1. The State Fire Marshal from enforcing the minimum fire code\n\nrequirements as allowed by law and revoking the operations of a\n\nmobile food preparation vehicle for cause when such vehicle is\n\ndetermined to be inherently dangerous to the health, safety, or\n\nwelfare of persons within this state;\n\n2. A political subdivision from enforcing the event permits,\n\noperational fees, land use regulations, zoning, or other ordinances\n\nin relation to the operation of a mobile food preparation vehicle\n\nwithin the boundaries of the political subdivision; or\n\n3. The State Department of Health from licensing and regulating\n\nmobile food preparation vehicles as provided by the provisions of\n\nTitle 63 of the Oklahoma Statutes and rules promulgated by the State\n\nCommissioner of Health.\n\nG. The State Fire Marshal may promulgate rules necessary to\n\nimplement the provisions of this section. Such rules shall have\n\nuniform force and effect throughout this state and no political\n\nsubdivision or other agency shall enact or enforce any fire or life\n\nsafety code-related ordinances, rules, or other requirements for\n\nmobile food preparation vehicles, except in a county with a\n\npopulation exceeding four hundred thousand (400,000) according to\n\nthe latest Federal Decennial Census.","path":["OK Code","Title 74"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os74.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"37828a88088c801cad0b034e16b63aca53ef90e15bb6f6437e7170793773b5ab","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-74-74-325.2","next":"us-ok/okla.-stat.-tit.-74-74-325.3"},"notice":"GroundRules: Original legal text.
